If he is a car dealer then he shouldn't have any problem paying for damage....they company insurance will cover it, not him.

maybe you or the other guy didn't set your parking brake correctly...and the car moved a little after you walked away...OR maybe someone hit your or the other guy pushing the two cars together...anything could have happened.

It had dealer plates. It was either some moron car salesman or the dealership owner's son. Either way, he will be in big trouble. Try contacting the DMV, explain the situation and ask them to contact the dealer.

How many Lexus dealers are near your office? Even in Calif., it can't be more than a few. Try contacting them yourself with that plate number.

Of course the culprit will lie about hitting you, but complaining to his boss (or dad) can't hurt.

Angry I'm pretty much screwed

Just spoke to the insurance adjustor and she says that I'm 99% screwed unless the other insurance company accepts the damage which is unlikely. She says I was screwed from the start.

The police would have only came out if it was major damage, or if there was an injury or for illegal activity in progress. In CA, they are only required to take a counter report for damages over $500 if it doesn't meet one of the above criteria. The adjustor said that a counter report is almost worthless and that the insurance report actually has more legal weight.

Unless, I was able to get the guys personal info all the pictures in the world are worthless without a police report. (see above)

For the police to write it up as hit and run, I or another witness would of had to actually see him hit the car and then drive off without leaving his info. Even though I saw the cars in contact and I know he took off without leaving his info that doesn't count because I didn't see the actual collision happen.

So now I'm stuck having to pay the $500 deductable.

One person suggested, that I might try to take it up with the dealership directly. Since I have picture proof, they may try to settle than have the bad press from me trying to sue them. I'll figure it out after the insurance company finishes their investigation.

If you're gonna buy into everything the insurance company tells you -- why even ask us in the first place?

You should have:

1. filed a police report already (at least make an attempt instead of pondering it)
2. Contacted the DMV
3. Contacted the dealership directly

Unless you don't care to, and would rather pay your $500 deductable, stop asking and start demanding.

Just do it!
