Default is my car lemon?

im starting to think i might have to get a lawyer soon. I'm having so many problems with my car, a lot of them are minor some are major. Mine is an 04 with an 04/04 build date, you would think most of this crap would be fixed by that time.

transmission still grinds in 1st 2nd 5th, this is the second tranny
engine is now consuming over a quart of oil between 3k mile changes
rear axle click
whining noise coming from rear of car at 50 mph when deacceling and at ~80-90mph when crusing, dealer cant figure out what it is. Its extremely loud, i can hear it over my stereo.
tire feathering showed up at 10k miles, i have no doubt it will be back
windows dont always roll all the way up, "fixed" by nissan twice, still does it
seat still moves around under hard accel or around a corner, "fixed" twice by nissan, still does it
rough idle, its not due to my mods, it started doing it at 1k miles and its only gotten worse.
grease streek on windows, at least they were able to fix that
all of this with only 18k miles.
im going to take in one last time, if any of the major problems show up im gonna get a lawyer

I got a used 03 and had work done on it already by a dealer (only had 12k miles on it). I noticed the rough idle too, even after letting the car warm up. I figured it might be how the previous owner broke the car in but I'm beginning to wonder since you mentioned it also (I have an Injen cold air bolted on).

Did the dealer fix the idling prolem and have you heard anyone else having idle problems?

I don't know because I don't have one yet, but I hear grounding kits will smooth out your idle.

plenty of people have the idle problem, havent heard of anyone getting it fixed. In my case they just blame the intake or the plenum.

at idle the engine is rough and inconsistant, the tach bounces around a lot.
