i dont see how you restrained yourself. SO what if the lady was in a rush, she hit your car, its unlawful to leave! Dealership should have taken ALL her info(if shes attractive, take the cell # on a separate piece of paper) and then have the witnesses write down what they each saw and had them each sign his own.
i[ I do have to say age doesnt help when they think im driving Daddys car.]i
feel your pain there. Im 20 and im sure most everyone assumes my dad pays for my car but he doesnt. Not to mention rent/food/insurance since i was 18.
But where i live, 90% of the 19-23 yr olds are driving 'daddys' car ranging from new VW's,Acuras, giant suv's, to merc and bimmers and a few 350z/g35c. <---- Lucky bastards

i would automaticly assume that the dealership has the persons "real information" why? this person probably came for a oil change or some maitence, wich means they are on record. Its hard to believe a nissan car came to an nissan dealership just to ram your car then leave, they was there for a purpose/function wich means most likely there information or at least there first and last name is on record.

On the side from complaining to Nissan North America and my insurance backing me up, Im sending a copy of all this thread to the dealer so they dont think that no one will find out but instead they will know everyone knows how they work.

Sorry man I feel for you.
Although the dealership parked your car in a crappy spot, it's still the dumbass woman who sideswiped it. What I'd be concerned with is that the lady just took off and the dealership let her (and the damn manager is "out to lunch", yeah right).
I hope your insurance guys drill those people a new a-hole.

im not sure how it works in cali but I work at an automotive shop in nevada and when a vehicle is in our posession it is our responsibility to take care of the vehicle until it is picked up. ie. if someone drops their car off for a brake inspection, we have to keep care of it even if it's overnight by pulling it in and out of the shop. and if anything happens to it while it is in our posession then we are responsible for damages. even if a vehicle is left overnight and it is broken into or even stole we are responsible. Unless the vehicle is paid for and the keys are handed over.. then it is no longer our responsibility. I would go after the dealership, especially since your in cali because the laws are stricter there...

Try to do it without a lawyer.
Since you were not hurt, all you're really intitled to is a fixed car and a rental if you need it.
Bringing in a lawyer will let him grab 1/3rd of your cash.

subscribing, will like to see the outcome... and as mentioned above it should be the responability of the dealer to take care and reponsability of the car whenever it is in their possession

Sorry man... it's typically characteristic that companies in such situations try their best to accommodate you, but they seemed like they could care less. Hope that everything works out for you, with the least amount of stress possible.
