Default destroyed!

Sitting at a stop light last night, It all came to a quick end. I looked in my rearview mirror in time to blurt out "O MY" before I could even get out the last word, a drunk woman in a 91' camry slammed me from behind at about 30mph! no attempt to slow down, no skid marks, just mass destruction to my Daytona Blue Touring, all options but spoiler, It wasn't even 2 months old, only 2,078 miles. My biggest fear now is that her insurance will try to repair the car. It was difficult to tell the damage at night, it didn't mess up the back hatch at all, just destroyed the bumper, taillights, and buckled the body on the driver side behind the door. I'm hoping the buckle is frame damage, because I will not accept repair of this car! With the newness of the car and overall value of z's at this time, I feel the car must be replaced due to the automatic loss in value to a wrecked car.

I know it will be a fight to get a new one, does anyone have any words of advice? Dare anyone look upon my destroyed Z if I post pics?

I'm sorry man. That's a terrible terrible terrible thing to happen. But really not as terrible as loosing a life. Think positively. Eventually you can get any car you want, if you are alive and healthy. So be happy about you being alive instead of greiving about car.

Now about insurance. Can't say anything particular. But the common idea is that insurance will always try to screw you. Always. First her insurance, then your own insurance. That how it works. That how they make money. But if you'll give them troubles they might do what you want, and go screw somebody else, some easy prey. So don't agree to anything untill you know it's in your interest. Be consistent about what you want and don't let them play games with you.

One more thing. Record dates/names/words said from every you conversation with insurance. Will help a lot to avoid walking in circles.

It took my wife more than a year to make our insurance pay everything they had to pay by contract. But eventually they did when they saw she won't let them go. And that was reputable Citizens.

Sure, post the pictures.
BTW, now knowing that Bose sucks, you can get Performance, put your old leather seats in it, install nice stereo, and save couple grands.

Damn! Are you alright? I had a similar accident to my Accord back in '98. It took forever to get fixed, and it sucked after that...I wish they totalled it.

Damn!!! I hope they fry that stupid ***** and take away her license forever. There's no ****ing excuse for drunk driving. Glad you're okay, and good luck with the battle for a new car.

Oh MY GOD! I hope you're all right - 30 mph running into you at a standstill - I can't believe you're operational but glad that you are! Good luck in the insurance battle. Please post pics if you can bear it ... we can all cry about it together.

for you, sorry this happened, glad to hear you're OK, life is more important.

Now, I had my truck totaled a few years back and the first thing that was said was that it could be fixed. No way would I accept it fixed in the condition you described. If one company says it can be repaired I would go find someone who will tell you it is beyond repair. Good luck and I am real sorry to hear of this misfortune.

BTW, I had my Z hit by a hit and run, driver was a B----h, high on drugs, car stolen, luckily someone in the neighborhood had seen her and her friends driving around the block a few times and called 911, so the cops were on their way but not until she hit my parked Z while I was asleep.

I was lucky, not much damage but I was pissed to say the least. I hope you get a replacement (Z) soon

Go see a doctor because you have back/neck pains. INsist that you are having pains(doctor can only believe you) and sue that Bi@#h for all she's worth. Normally I dont advice this type of behavior, but there is no excuse for drunk driving. She could've killed somebody.

If you see a doctor , most likely they(her insurance) will try to settle out of court.

Damn! I'm so sorry about your beautiful car. But the important thing is that you're okay. I had a friend in high school that was killed by a drunk driver, so you're really lucky.

Don't accept your car as repairable, I'm sure a shop will total it and make sure that stupid b%tch pays for every last cent of it! I hope she rots in jail, too.

Thanks for all the sympathy, it helps to hear your tears. Agreed, very lucky to be OK for the most part. Did go to the hospital, and do have some suspected internal bruuising of the splein, and whiplash. Defenitely sore today. Just incase anyone needs more reason to hate on this Bizzzatch, when the ambulance arrived, was the first my wife and I discovered she had 2 children under 8 yrs. in the back seat. When the accident first happend my wife called 911, when the BTCH heard that she got back in the car and tried to leave, but was blocked in. When she finally got out she stood in the street screaming not to call the police. So it was probably 4 minutes before help arrived. At this point she hadn't even looked in the childrens direction, so we hadn't noticed them in the back. It wasn't til the medics noticed them in the back that she acknowledged them by yelling, not concerned. The police had to drag her away from the car so the medics could help them. One of them was hurt, medics said should be OK though.

I will do everything to make sure this woman never drives again!

I'll go see the car & get pics tomorrow, thanks for the support!

i have progressive insurance and had a similar incident with a drunk driver at a red light. They were at my house a few hours after the accident did the estimate and cut me a check right then and there. As far as replacing your car, not likely unless it's totalled and from your description it's not. Insurance companies only cover the book value of the car uless you have and pay for collectible status. It sounds like ******** but you agreed to it when you purchased your insurance. If it cost less to fix they will. I know of another horror story with a bad ending involving a Viper that was in the dealership for service and the mechanic smacked it up. Dealer agreed to fully pay repairs but the owner of the Viper said the car was a collectible and wouldn't be worth jack repaired and repainted and he wanted a new one in pristine condition yada yada yada. Fast forward to court, the dealership won. Judge says you aren't entitled to the future value of the car only what's worth at the time of occurence.

I got smacked from behind by a guy doing about 30 3 years ago. This was in my Aurora... it was a nasty fight to get the thing repaired at all, let alone correctly. Make sure, if it isn't totalled, that you are there when they do the repair estimate. Make sure your seats are solid and do not rock on the rails. My seats have always been a tad bit loose since the accident -- nothing big, but not solid like they used to be.

Sorry about your luck pal....This woman should be locked away for life after endangering her kids and your life.

1. Make sure you go to the doctor, create a whiplash and injury lawsuit. Talk to lawyer, describe the details and get advice possible legal action and suffering lawsuit. Half the time the insurance will settle out of court, say for $50,000.

2. Get car repaired and take $50,000 and buy another Z. Take wife on cruise and enjoy 2 Z's in the garage. A 30mph hit is no joke.

I agree with cantzme. I got into an accident with my integra. and the lawyer told me he wouldn't even take my case unless i went to go see a doctor and tell them my neck hurts. So basically i went to the doctors once a week and got a massage. lol.

Tell her insurance company you want reimbursment for the diminished value of the car if they insist on repair instead of replacement. Advise them you will take the car to a professional appraisal service to have the car's value evaluated once the repairs are complete.

DO NOT sign a damn thing with them until they agree, in writing, that you should be reimbursed for the reduced resale value of the car. If they refuse then contact a lawyer. There's no reason you should have to accept the reduced value of your car since their client was clearly at fault.

I can't believe that the woman was screaming in the street not to call the cops, had her kids in the back seat and didn't care, and tried to get away after you called 911---UNBELIEVABLE! Take everything she has.
My girlfriend was in an accident similar (but not quite as bad) - her biggest problems is her neck-- never been the same! Insurance can't pay enough to get your range of motion and lack of body pain back. Damn shame. Listen to everyone here- they are all correct! See MD!

If you have any problems with the insurance company, I suggest you get an attorney (preferably an attorney you know and who deals with personal injury). It's the only way to get what you deserve when an insurance company decides to play games! Even if you don't have problems, I suggest you consult with an attorney before signing any settlement documents. You should have your own attorney in addition to the insurance company's attorney. Good Luck and I hope you're feeling back to normal soon.

i feel for you man. Ii hope everything works out. maybe she is wealthy and you claim a civil suit against her. But wow. she is such an idiot for endangering other lives by DUI.

She should go to jail. Did the police do a test at the scene of the accident?

This is EXACTLY what happened to me 2 years ago. MLK Jr. day to be exact. I know exactly how you feel. Did you let them take you to the hospital for a quick exam to make sure your ok? Only thing i see different was that i was hit by a large old chevy truck (tank) and it jsut completely crushed my trunklid all the way in to just below the base of the rear windshield, damage carried all teh way up teh body panels, i was thrown into teh car in front of me, yet surprisingly NO FRAME DAMAGE!!!!! 6700 dollars (insurance paid for) and 2 months later my little sister got her first car. It had to sit in storage until she got her license but at least she had something waiting for her.

Im glad that your ok and all, and trust me that youll be watching your rearview mirror a LOT more often from now on, but you have to remember that theres nothing you can do to avoid an accident of this sort. Just be glad that you were able to go to bed and know youll be waking up in the morning.

1st -- Be glad you're alive.
2nd -- Get a lawyer (trust me on this one). Insurance companies are the enemy and WILL SUCK YOU DRY (in a bad way).
3rd -- Slip the mechanic where you took the car a $50 to declare it a "total loss" ie repair costs exceed value of vehicle.
4th -- Buy new Z, hope drunk people hit the classic drunk-target (a tree) instead of you.
5th -- Enjoy new Z. Life is short, smell the roses.
