Cancel 06 order for 07? Can any dealers help with info?

Default Cancel 06 order for 07? Can any dealers help with info?

Hi all, first post here.

Heres the story:

In May I put down a deposit for an '06 black on black 350Z with the Performance Grand Touring Package. At the time there was no stock with these specifications in my area and the surrounding areas.

The dealer then placed an order to the factory in Japan for one to be built.

Fast forward to now: We have all heard of the changes for the upcoming '07 model. I'd like to transfer my deposit over for the '07 model and the orginally ordered model can be sold to someone else. The car they ordered is still not on North American shores yet. I haven't signed anything besides the 'Offer to Purchase' with a negotiated price. The dealership is saying that because the car was order from Japan, I can't back out and wait for the '07 model.

Can anyone, possibly someone working at a dealership, confirm/deny this and suggest what I can do regarding this dilemma?

You can always back out, but dont expect to get that deposit back..

The dealer is correct. If you back out now, you will forfiet your deposit. I doubt that they will let you transfer it to another vehicle, because they already have a car ordered for you. Sounds like you'll either have to keep the 06 they have coming, or bite the bullet and lose some money. And remember...there will always be something newer and better. Would you rather be driving the car soon or waiting another 6-8 months?

Ouch. I put down a $5000 deposit (my credit card gives cash back at the end of the year). The offer sheet says nothing about the deposit being non-transferable. In fact, the offer sheet only mentioned that they would 'Locate' as written in the 'Stock' section. It says nothing about ordering from the factory.

It won't arrive until late August, early September according to them. I've already been waiting since May. A few more months for an '07 is worth it at this point, if its feasible. Thanks for the input.

I mean, these guys can always take the '06 that was ordered and sell it to someone else. I'd still be buying the '07 from them. I know they're not under any obligation to do such a favor, but this dealership still has a new '05 on the lot, so why not an extra '06 when its still 2006.

Instead of taking the loss or trading, make lemonade from your lemons man. Go out an Buy a Nice Turbo Kit or Super Charger and dont worry about it. Since it is brand new, you can get a Super Charger for around $5K with a matching 36mo Warranty from Stillen and be golden.

Which is EXACTLY why they do not want another new car sitting on their lot. I doubt that they will let you swap, but its worth the try. No matter what anyone says on here, its entirely up to the dealership...check with them.

You signed an offer to purchase a 2006. You get a 2006. Pretty simple.

This is why I suggest that buyers add a stipulation to any offer to buy:

If the vehicle is not delivered on or before [date] this offer is void and the deposit will be refunded.

What if you get it voided through your bank or something. Don't know much about that but maybe the bank can help? Say you accidentally did it or someone else did it haha. (Um...I was kinda drunk and put a 5K deposit on an 06 Z...erm...).

They've had the money since May. I wouldn't try and void the transaction even if I could as that wouldn't be right.

I'll try and talk to them anyway and update when I can.

Why not just have them put the deposit towards an 07, I would think they would do that.

I also had to order mine. When I gave them a deposit, I specifically asked the salesman about changing my mind before delivery. He said there would be no problem getting a full refund. He said they would just sell it to someone else. Maybe it's a dealer thing....

Hey guys,

I have been reading the reposts from this current heading.

I don't know much about the 2007 from the current models, currently I have an 2004.5 and I know my question in this headline might be a repost question but what is scheduled for the 07 that is going to be that different from the 06's and the models previous to that?

And do what? He signed a contract to buy a specific '06 model, and make a substantial downpayment to demonstrate his intent. Why would the court assist him in breaking a valid contract?

Actually, I really am surprised that the dealership is not being more cooperative, but they really have no obligation to release him from the agreement.

When we make mistakes, we can't blame someone else.
