Default dumb dude backed into my car

Ok... bad day today.. was in a parking lot and this guy reversed into my front driver side door...

All i saw was headlights and BAM!! I'm ok, but as I was stumbling out of my car this @$$ hole doesn't even care if I was ok and starts saying it's my fault.

the other guy and I both have gieco, which makes things easier. He was argued that I was going the wrong way, but it was a 2 way parking entrance.

In the end he was in Reverse and is considered at fault (at least by gieco)

Anyone know a good body shop in the east bay, ca? I'm in hayward... need a good shop to fix this puppy up..

I don't know what the law is in Cali, but in NJ, a parking lot accident is no fault. In which case, you'll be a lot more pissed off.

But at least you're ok.

I talked to the gieco insurance folks and they said because he was in reverse, thus he is as fault

>< not true. I got reveresed into by a garbage truck. I went thorugh my own ins company and in 2 months i recieved my deductible back cause it wasn't my fault.

In Cali, a driver can definitely be determined to be at fault in a parking lot. Awhile ago, someone wasn't looking when backing out and clipped my Prius as I passed by, knock the rear bumper cover off. The other driver's insurance company found their driver at fault.

yes but if both of u back out and hit eachother then its both ur fault in cali i think
i get scared to back out cuz we practicaly have no rear window or visual

Thing was I had the right of way and he was in reverse...

I'm glad i'm not hurt, but dang dude... sucks when your Z is in the shop

I had the same thing happen to me except I was in a gas station and the lady was deaf.

It was her fault for "unsafe backing", I hope you made a police report.

Anyways, I know plenty of good body shops in the east bay, EMC collision is one that comes too mind.

No police report yet, called they hawyward police but they refuse to show up because it was a private property (parking lot).

Who do I need to call to file this report to the city?
