make sure to get compensated for 'loss of value' not sure what it is called but a great point. if you go to sell your car, trade it in, etc. you are gonna get burned because of this.

Well on a new car (2006-2007) you might be able to argue that but I am not sure since its a 2003 that he will get too much traction. I have seen a lot of people with real new cars get some money from insurance companies but I have always driven older cars when I have had wrecks and they have told me the loss of value on an older car is usually nothing (of course we know in the real world this does matter)

Car falls under personal property and a pain and suffering/mental anguish claim cannot be filed for personal property. Property damage, loss of resale value, any $ foregone due to missed work, and hospital bills are all that can be claimed.

I'm not sure if it is the same out there, but in California you need to report it to the DMV by law within a few days. Call the DMV to see if you need to report this.

You might want to get a lawyer involved here. His insurance company will reimburse you for 1) your vehicle damage and 2) your personal injury. However, they aren't going to hand over the cash and they won't offer more than they have to pay. If you want money for your car's depreciation due to the accident or if you want to raise the case of reckless driving, you will need a lawyer to walk you through that.

And since it is his fault, his insurance will pay your lawyer fees.

And like the guy said above, go get yourself checked out right away. If you wait too long, his insurance will wonder if you were even really hurt.

Neck injuries are serious, the pain might go away after a while, but can come back later in life.

If you are experiencing any pain or physical issues you need to be seen by your doctor to document your injuries.

You need to be careful of the release that you sign as you need to make sure that the release is for your property damage claim and not for your personal injury claim. It is too early to resolve your personal injury claims as you have not been able to establish just what if any injuries you received.

Companies don't give a **** about emails. I bet that mail to the president got as far as his secretary, if that. You've got to show up in person (with a lawyer if possible) to really scare the bejeezus out of them. Or go to the media. ;D
