Florida may be one of several states where you cannot be charged with auto theft unless you move the car.

Oh well..whatever the most I can convict him of I'm happy. I'm just happy he was stopped, he wasn't armed, and that he was arrested and I still have my Z and my life. I thank God for my safety.

Most states have laws regarding use of force by police as well as citizens. Basically, the use of any "reasonable amount of force" is allowed to protect life or property.

The fact that you may have used less than reasonable force is actually good in one respect: He can't use the beating he got as an argument for saying you were the aggressor. Not a good defense on his part, but I've seen it used before.

It sounds like he's guilty of attempted theft, since he didn't actually get a chance to steal the car yet. So they'll probably charge him with that, which means he may get a plea bargain for something less, possibly even a misdemeanor, depending on how good his lawyer is. On the other hand, you have about the strongest case possible against him, and he has priors, so they may try to stick it to him.

Gyms must be really bad for theft (a great place for a thief). I used to work at a pro shop in a gym and people got stuff stolen all the time in the locker room. The real question is, why does the gym continue allow it, when I'm sure it happens all the time. I mean they have everyone put their keys out in the open... kind of an obvious place to steal a car eh.

the gym i go to is also the same. We usually leave the keys hanged on the wall. I try to park my car right where i can actually see it. Im surprised the guy didnt swing at you to knock you out so he could get away. 5'4>6'2 FTW!!

Thank God you got there in time. When I used to go to a gym (I have a home gym now), I wore a fanny pack, which I stored all my valuables like keys, wallet, and phone. Left my duffle bag in the locker which only had towels, extra clothes, and showering products. I'd definitely suggest something like a fanny pack.

ooooooooo fck I would be hot if I caught someone trying to jack my car... but that's a real ****ty time to catch someone way bigger than you acting a fool....get out of the gym and you feel like a ton of bricks already...
