Mine had the stock spoiler attached. The problem I believe is that the strut is just too small considering the heavy hatch the Z uses.

But, to the OP, you would not win any suit unless you could show some type of damage occurred due to negligence on Nissan's part.

There are more important things in the world to worry about.

I had my struts replaced under warranty and after a week the hatch still didn't stay up. At that point I said F*UCK IT and realized that Z's weren't made to put things in the trunk anyway.

Just a thought. My NISMO has the heavy wing added to the car. I am willing to guess my struts are different than the normal ones that come on the Z. Probably stronger.

Unfortunately, you can sue for something as little as this. However, the outcome will only be Nissan modifying those struts and replacing the old. It actually is open to sue, but is it really worth it?

It will never make it to court.
Nissan will say. the car is 4 years old now. Replace the shocks on the hatch and have a nice day.

I'll sell you some if you need them

I would tend to think so, but not sure. The ones in my '04 are about the same size as my vette's (and they are small, since the trunk lid is extremely light).

In the summertime it wasn't as bad, but still noticable, but in the winter, it really didn't do squat to keep the rear hatch up. I too was a victim of the hatch hitting my head incident. It doesn't feel good.

Not to sound like an *** but how soft if your skull that a hit on the head from the hatch would cause you brain damage? It takes quite a bit of force to cause brain damage. A concussion..... maybe.

It happen to me once...just replace the strut..no need to go after nissan for that...If anything else..I would go after the dealer..some dealer are ok..but most suck after your warranty ran out...they jack up the price so high on almost everything..

my god you must really need some money! lol My hatch doesnt stay open when its cold usually. Its bumped me on the head a few times, but whatever. I still love my Z and happy that Nissan made it. I say this 'lawsuit' is a lost cause...........BUUUUUUUUUUUUT if you do proceed with it and win, send me a PM and everyone else on here a PM, we should all get paid then hahahhaa.

what if, what if, what if......

You need actual damages in order to file any claim against Nissan. Was this not covered under warranty? Secondly, is this a complete mechanical design problem that HAS injured (severely) someone? Thirdly, from where you stand right now, it wont be worth the expense to file a suit against Nissan for your meager claims. Do you have any idea what kind of attorneys Nissan has? Lastly, what was in the sale contract you signed. Most car companies have exculpability clauses which you agree to in purchasing the vehicle. These clauses remove any liability on the part of Nissan and your dealership for any damages caused by your vehicle.

Let's not jump to sue people. The system is congested enough without bs claims like this being filed.

hahaahaha some of the comments are TOoo FUNNY!!!!!!!!!!!!!!!! ... but i agree with all.... i had a TRD spoiler on my last Celica and the trunk wouldnt stay up for anything... i got hit like every time i opened the trunk... my head got used to it... =D ... so now i got that NISMO V2 spoiler on my Z and haha same thing... keeps hitting me in my head every time it falls down... =D ... "crap that hurts! WTF?!?!?!" and just move on =D
