Default UPDATED 3/3/08: Got in an accident today..

UPDATE 3/3/08 : Saw the adjuster today and just as a preliminary estimate they quoted me...$5139.52. This DOES NOT include the tranny and other issues not seen. This is just the body work and labor. They said they expect it to be higher after doing a thourough check.

estimated turn around time is 25 DAYS!! yes 25 DAYS!!



well i thought it would never happen to me. Today around 3 pm i was at a stop sign behind another car. And out of nowhere a toyota corolla plows into me from behind. He hit me so hard i got pushed into the car infront of me and rear ended him. So pretty much i got F'ed on this one. Rear is smashed and the front is pretty damaged. I got hit so hard from the rear that the impact caused the rear quarter panel to cave in.

From what the witness said, the guy was flying at least 40mph and didn't slow down at all. She was driving behind the culprit and said she saw the whole thing. The van infront of me and myself were parked and he just ran into me. Thank god for her. She was more upset than me lol. She gladly gave me all her info and said if i needed a statement or anything that she would be more than happy to help.

i have some questions that maybe someone can help me on:

1.)Does california have a "NO FAULT" clause? My insurance was asking me over the phone and i didn't know (esurance)

2.)i have a 5AT and when i got hit, my transmission locked up. I was in manual mode when i got hit, and now the shifter will not move at all. the car starts but i cant put it into gear. But the weird thing is that the car can be pushed as if it is in neutral. My airbags DID NOT deploy, but from what i have been told is that even though they did not deploy a sensor could have been set off causing the transmission to lock.

3.) on what basis can i salvage the car, because even though the body doesn't look awful i don't think the car will be the same, and it's just gonna bother me until i get a new car.

i didnt take many pics but here they are. The pics i took makes the damage look minimal but if you saw my car in person it looks f'ed...

doesn't look that bad. if you were not at fault, just let the other persons insurance pay to fix it.

so exactly how do i do that, do i file a claim with his insurance? or will my insurance company do that? I haven't been in a accident before so i have no clue how it works with claims.

Well to answer number 3, a car has a salvage title when the cost of the damage is greater than or equal to 75% of the car's value. The cost includes labor as well. For example, if a car is worth $10,000 and it was in a wreck and the cost of the repairs is more than or equal to $7,500, it would then have a salvage title. If the repairs would have cost less than $7,500 it would have a branded title. Hope this helps.

By the way I would get a new car if I were you too. It will never be the same after the rapairs. Even if there is no noticeable difference in driving, you will still know.

you claim it through your insurance and they will give you money. in turn, your insurance company will want their money back and go after her insurance company. i think you can also just get it directly from her insurance as well. im not sure though, ive never done that.

on a side note.. if you did total your car, ill be more than happy to take that front driver side fender off your hands.

The transmission locked up, because theres a senser that wont let you drive after an accident so you wont hit and run. The accident doesn't look bad, call your insurance and they will follow up with the other party.

is this on newer cars, because the guy who hit me was able to drive off. So wouldn't his car be out of comission too??

Not sure on the other car, I know this because I totaled my first Z and the inspector told me the motor was fine just that It locked itself on purpose. Which is good beacuse if your leaking oil and move the car you can really mess the motor up.

Thats what I was thinking. Glad you made it out ok, and your car doesnt look too bad a all. From a rear impact, the airbag system is designed to not go off, there wouldnt really be any point to it, a possible risk to injury from the airbags is all.

Sorry about the loss. California is not a no fault state. Basically, you have two choices regards to getting your car repair. You can go thru your own insurance and your insurance company will go after the responsible party's insurance.

2nd, you can go thru the responsible party's insurance directly, but you have to wait for them to complete the investigation so they can accept liability. The 2nd choice might take longer because of the investigation. But its good that you have a witness just in case the responsible party dispute the liability.

From the look of the pictures, your car shouldnt be total. Maybe you can do some body mod since insurance will pay for the repairs. Gl on everything.

I'm not sure but I think the best way is to get the money from the other party's insurance company, to avoid making your insurance provided pay out. Generally the more they pay out, the higher your premium goes when it's time to renew the policy.

Not sure if you were actually hit at 40mph. If it was, your Z would look like a clown car by now. The front actually looks worst than the rear, and I doubt they would salvage it. Good luck fixing it up

The Toyota was NOT going 40. The car will NOT be salvaged. And no offense, but it sounds to me like you're trying to make excuses to get a new car. It has front a rear bumper cover damage. The body looks straight, no body filler, no new paint on the body, nothing. The car will be the same. Nothing different than the 50-60% of the people on here that put body kits on thier car.

Ohh and I want to see this "caved in" door. I find it funn that there's no play in the body to do a thing to the door. And if it was caved in that would be worse than the damage I see and you have no pics of it?

Not trying to be a douche, just looks really odd to me.

Have to agree with everyone else. No way would that be salvaged. Bet a good body shop will have that knocked out in no time. Good luck man!
