my z got into accident.....totaled??
So, I was stopped about to make a left into my driveway and all of a sudden, i get this wierd feeling and look in my rear mirror only to see headlights coming on quick.....knew i had no way to bail so i just braced myself for the hit. he hit me and launched my car forward at least 50 yards....i didnt even hear him braking and he must have been going at least 55mph (street limit is 45)....its a pretty big street but i am legally allowed to cross double yellow lines to enter and exit my driveway.....cops came and did the sobriety test on him and arrested him with suspected DUI....
so, as far as damage, his car (jeep wrangler) had a metal front guard which directly hit my rear crushing the hatch and bumper.....i think everything from the front seat back will need to be replaced, the frame was bent so that one end was rubbing against one of my rear tires.....
i know its tough to comment without pictures but do you think they will total my car? I have a 2004 enthusiast with 35k miles......
ill try to post pictures - didnt have a chance to take pictures and the car is now sitting in a yard waiting for the insurance adjuster.....

It is not necessarily totaled if the frame is bent. Depending on the damage your car incurred, and with how you described this dumb sh.it slamming into your ride, it doesn't sound too good. There are alot of factors that could determine your car a total loss, like did the airbags deploy etc... etc... The insurance company will determine the car a total loss if the damage exceeds 75-80% of the cars total fair market value, as this amount does fluctuate and is dependant on where you live. Alot of things come into play with the way they determine this amount such as the condition of your car before the accident, mileage, model/trim etc. If your car is totalled,I would recommend that if you had any aftermarket parts on the car, to take them off and replace them with oem parts (this is the only perk but the insurance company will allow it) and either use them on the next Z if that's your plan or part them out and make some of your money back (you might wanna do this quickly because them slimy sh.its over in the impound lot are not very trustworthy and will take your stuff. Also, here are a few more pointers... The insurance company is going to low ball you, that's what they do. You do not have to take their first offer, and yes you can reject and request a higher settlement if it is totalled. They are going to want to settle with you rather quickly because they have to start shelling money out to the impound lot after 2 weeks for storage fees, so be careful with what offer amount you take. Most insurance companies will pay up to 30 days for a rental car, so take advantage of it! Also, if you purchase a new car within 90 days of the day it is declared a loss (if applicable) the insurance company will also be obligated to cut you a check and reimburse you for the sales tax of the new vehicle as well. Just some food for thought, but hope it doesn't lead up to this. It is really gonna be hard to tell without physically seeing the damage. Sorry to hear about your Z either way.

Edit - NVM - did a google search and Connecticut, for one, has some laws regarding that. Still, a lawyer is the best place to start. I would have called one the next day, for sure.

Understand that in most cases, lawyers would not take on such a case because there is no substantial amount of money in it for them, and in most cases you would end up spending more on legal fees than what you could ultimately end up getting out of it. We are talking about a possibility of a total loss here. If both had insurance and everyone is complying, a lawyer would be useless (unless) the OP incurred any type of bodily harm which would be a different story. Either way, laws do differ from state to state, so that needs to get taken into consideration as well. I suggest you ask your insurance company alot of questions OP and start doing some homework, it will only benefit you in the end.
Really? And which states are those? I would think that would have to involve a civil trial, at a minimum. Link? Or internet/urban legend?
