Doesn't it suck how emotion is more powerful than judgement? I am sorry to hear about your ordeal. Good luck. I also agree that it sounds like it was either A) demo that was wrecked or 2) the dealers test drive car since day one that probably got wrecked. I would not be surprised if the body shop's conclusion was that it was damaged. Then you should raise holy hell.

 

I would bet money it hasnt been in any accidents. No way the dealer wants the consequences of what would happen to them.

 

I truly hope you are right. I will keep the car if they prove it wasnt in an accident by showing documentation of why there is overspray etc...

If they have to repaint due to the imperfections, then I dont want the car

 

Definitely abnormal to have a new car with 800 miles. My Z came off the truck with 14.

I've got bad news for you dude. You REALLY need to determine if that car has or has not been in an accident...here is why:

In a case called BMW of North America v. Gore (517 U.S. 559 (1996) if you wanna look it up) Gore sued BMW for repainting cars that had been subjected to acid rain, repainted, and then sold as new for the full sticker price. Dude won $2million but the supreme court shot that down. If you wanted to sue and it HADN'T been in an accident then you probably won't get the full value of the car since the court ruled that the paint is not an integral part of the car.

IF, on the other hand, they wrecked it and then tried to sell it as new you have been defruaded my friend.

I live in Newark, DE and I hate to say it, but the dealer you purchased car from is known for being a crook. If I am not mistaken, they are in the process of going out of business or transferring ownership. I would just go in there and raise hell and start spitting out fictious lawsuits. I purchased my Z from Sheridan in New Castle, DE. It was a delightful experience and the C/S has been great so far (2500 miles). Let me know if there is anything I can do for you hear in northern DE.

 

Thanks man. I had heard they were going out of business but I was not sure. Funny thing is, I did talk to Rob at Sheridan the other day. He called me and told me he could put me in an '03 touring for what I'm paying now. I go to Newark a lot since my brother goes to school up there.

Definately get some legal advice. For some reason the number 300 sticks in my head as being the mileage limit under which a car can be sold as new. But this probably came from a car salesman so who knows. Ay any rate, it appears the car definately had body work done. You should use whatever means to get out of this deal and go with the new car from the other dealer. Roast this fraudulent dealer alive.

 

I have bought new cars in many different states. From what I have seen (and what dealers have told me) this varies state by state.

I once bought a new Toyota Pick Up off the lot in Colorado. It had 96 miles on it and was sold as a DEMO due to the "excessive" miles on a NEW truck...

My Z I bought in PA had 204 on it when I took delivery of it. ( 74 were from me personally driving it back from the original dealer in NY that traded my local dealer for it.)

Out of curiosity, did they extend your warranty to 36,800 miles?

Sorry to hear about your problems. To the best of my knowledge, any car that has over 100 miles is not considered new and should not be sold as such. The reason for this number is that it takes 2 or so miles to drive it on and off the truck and then the dealer takes the car for a spin for 2 or so miles just to make sure everything works. The other 90 or so miles allotted is for test drives. Anything over 100 makes it a demo car. I could be wrong but 800 miles is way over that limit.

As far as the problems you are having, it sounds like you have a very early production car (i.e. cars made after Dec./Jan. or so dont have the Bose volume problem as the new amps were placed in the car). So, not only did you not get a new vehicle, you probably got one sitting on the lot for months, or in your case being driven around for a few months.

Just curious as to what is your VIN#. By the way, if you decide to take a legal route, you have a viable suit under contract law to sue for fraud and misrepresentation. Your lawyer can claim negligence on the dealer's part for selling a used car as new, and also fraud and misrepresentation because the dealer should've known better. If you have any more legal questions, PM me and I'll try to answer them as best as I can. Once again, I practice in Southern California so the procedure may be different, but the law is pretty much uniform. Anyway, good luck with that and dont give up on the Z, cause for all you know you may get a new one out of this.

 

Sounds to me like a demo that got dinged up, and the dealer tried to cover it up by having the spots repainted.

 

Quick picking on Stabber, he bought a high mileage new car and needs some support. You all keep bringing him down.

Stabber, Take on the dealer, tell them you are getting a lawyer, write a letter and send it to the local newspaper, copy the dealer and Nissan in your letter. Make the letter about the the Dealer, not Nissan. Good luck, fight for what's right.

sounds used and wrecked, take it back to the dealer demand another car, a new one at that. No new cars come in with 700+ miles.

 

well i did go last saturday and talked to the salesman and manager. They both were very friendly and nice so I didnt have to get loud. I specifically asked them if it had been repainted or ever wrecked. He said absolutely not. He came out and looked at the car and said the overspray was actually from the white tape the car ships with

I showed him the other imperfections in the paint. He said to just wait for the NNA rep to come out to inspect the paint this week. He asked me if I was happy with the car and I told him it had some problems.

I did a carfax and it turned up nothing. Should I trust what the NNA rep will tell me? I havent heard back from the other guy at NNA who is building my case either. But, I am keeping everything documented.

Right now, it all depends on what the NNA inspector tells me. I'm going to specifically ask him why there is overspray on 2 of the windows and bring up some of the other issues. Honestly, I do not know if this car has been hit or not. I think it may have been *touched up* though.

I exaggerated the interior pieces a little bit in my previous posts. There were only 2 things that were loose. And one of them was fixed by snapping it in. (near the dead pedal). The other interior piece was on the bottom side of hatch...havent explained that one yet. If they tell me the car needs a repaint or has been in an accident then I'm making them take it back. I just hope the NNA inspector that comes will be honest. That is my only concern.

I will update this when I hear the latest.

It is illegal for the dealer to remove the Monrony sticker (price sticker) from ANY vehicle until the vehicle is actually sold/registered. There are HUGE fines that can be imposed on a dealer for this stunt.

The sticker cannot just "fall off" it is attached to the widow rather substantially.

I believe that this car was either a dealer demo, or worse yet a repo or returned car due to the original sale having credit problems.

Get out of this deal ASAP. Get a good attorney....
