my car got hit today on base, and i was just recently called by accident investigative department for PMO told me that it was my fault and are citing me for illegal motion of my vehicle.


story- i pulled into a burger king parking lot on camp lejeune and was going to park at the back of the parking lot and back in, like i always do. it is supposed to be a one way indicated by the arrow but they never abide by it. but i pull up to go to back in, put the car in reverse and all of a sudden while my foot is on the brake and my reverse lights are on a major(04) drives through the parking lot across 3 parking spots with lines and side swipes the rear of my car. he gets out and tells me that i backed into him. so i proceed to tell him that i might only have 9 years driving experience and and no accidents but i dont think the rules of the road let you drive across a parking lot and drive behind someone because you dont want to wait for me to back in. so 45 mins later AID(accident investigative dept) show up and fills out the report and sends us on our way. then i get a phone call around 5:30pm when im changing to leave base telling me that they are going to issue me a citation for illegal motion of my vehicle. and that there is no law stating that you cant drive across a parking lot across all of the lines, and he is in the right of way

so end result im a sgt and hes a major.
he got hooked up, complete BS

Yea, supposedly the PMO is supposed to be a separate system but yea....

Take it to the court. You have a right to contest it with the AG. Or maybe file a report with IG.

yeah i have to go and get the citation issued tomorrow and im going to try and contest it but im still going to have to appear in traffic court but the worst part is im more than likely going to have to have a strike on my insurance because of the major's pussified actions.

i forgot to mention that he commented to me that my wheels were really nice after it happened

 

Hence why I never combat park.

 

innocent until proven guilty. take photos of the accident scene, making notations on the layout of the parking lot and the direction that traffic is suppose to flow. place your car in the spot in which you were backing out of(and i would do this when the lot is empty) and note the path in which the major was driving("it is supposed to be a one way indicated by the arrow but they never abide by it")showing that not only did he cause an accident, but was failing to obey a sign or light. This should clear up any confusion of who is at fault.

 

As an ins agent, I would advise that if you are not at fault, to let them(your insurance company) know that you feel he was at fault and state your reasons.
