nissan warranty question

here's one for someone intimately knowledgable about nissan corp or someone as letigious as me:
i recent installed and HKS supercharger in my 03 touring. the install was done professionally and dynoed. the dynoed shows the charger was getting extremely rich over 5k rpm and affected the peak power. according to HKS they had the same problem with their early 03 test cars. at some point in early 2003 nissan made an ECU software update. after HKS got this update on their test cars they dynoed the way they were supposed to. so i took my car into the local dealership (i had a few things i needed done anyway like the grease mark, fuel door, etc) and they would not update my ECU unless there was a CEL/problem with the ECU. after much debate, they agreed to reflash my ECU with the update for $185. to end the arguement, i agreed. i feel like i am entitled to any software updates for this car. does anyone know nissan's policy in this matter? is there any way i can get the dealership to do this as warranty work? the car is in the shop today, so any help is appreciated.

I don't think you can. Software revisions are like TSBs, they aren't needed by everyone. Without the supercharger, your car was behaving fine and didn't need an update. $185 seems high though, about 2.5 hours labor?
