It does look the same. I just went out and looked again. After looking at it and opening the hatch up, I think its the bumper cover that is not aligned right on that side. I pushed on both sides in the same spot and on the side with the gap it seems to give a little more like its not secured properly. I am definately going to take it in now. I am not going to drive the next couple of years knowing there is a gap there.

i noticed that same gap on my 2004's hatch a couple months ago but its not nearly as bad as yours

I think its the bumper cover not aligned properly or something. I know I dont like it.

I have small gaps everywhere...
But I have replaced just about every body panel and did the work myself.

First check to make sure your rubber hatch bumper/stop is there on both sides. It might have fallen out at some point / been taken off or just plain forgotten during manufacture. Or, Maybe you could put a black plastic washer under the hatch stop. The other thing you can do is get the adjustable type at a auto parts store.

It shouldn't be a big deal to fix.

Then again you could just take it back to the dealer. They'll fix it. ;-)

Check for the bumper/stop, but I don't think that would be enough to twist the hatch. I'm thinking the bumper was damaged and replaced. Pop the hatch, and see if the bumper top-edge is the same position on both sides.

Yeah I am contradicting myself there. I should have noticed it earlier but didnt. Now I want it fixed damn it. I will go and take some close up pics so you guys can see more clearly. Thanks for the advice,

No worries, I'm retentive too. I would've noticed this on my own car or others if this were common.

How's the paint on the bumper cover look? In that last pic, it looks a bit off...possibly damaged and replaced in transit. I'm sure that is more common than any of us want to know and I doubt they ever tell anyone about it. All that being said, I'm sure they should be able to adjust it or the hatch.

In those pics it doesnt look as bad, but still noticable. Now its bugging me !!!!!! So you dont think there is any rule, law, ect... that says they have to tell you if the vehicle was damaged ?

If there isnt I think there should be one. Especially if it happened while in the manufacturer or dealers hands.

looks like fitment issue with hatch not the rear bumper.
I don't know if there is black peace rubber adjuster where you can turn it to adjust the level of the hatch like the one in the hood or door. if you know what I am talking about and if there is one, try to adjust it and see if that works.

You could be right. When I push down on that side the hatch does move a little and looks like it aligned properly. It moves about 2-3mm maybe. So does anyone know if the rear hatch can be adjusted ? That may be the problem. Anyway, I think it should be an easy fix. HOPEFULLY> damn I feel really **** retentive right now.
