The way to identify this as an OEM spoiler is to look at the bottom of it. If it has studs, or a place for studs, it's OEM. If it's plain, it's aftermarket. I recently got screwed on one of these... Maybe post a pic of the bottom.

I never saw this post, sorry and thanks for the info. It has 4 little bracket things on the underside that have things sticking out of them if thats what you are referring too. (im assuming when they come installed from the factory there are 4 holes in the trunk the clips go into) I will get some pics of the underside up when I get a chance.
