I haven't read all of the replies so if I repeat something already said thats why.:


1) Most parking lots like that are private property so the Vehicle Code does NOT apply... unless they have some signs saying Vehicle Code Enforced..

So go snap some pics of all the entrances into that place...

And the only person who can authorize cars being told is the property owner. Im sure costco doesnt own it, probably just lease it.

2) They can not just go into your car for ****s and giggles. They need probable cause. A reason to belives something is wrong or screwy with your car.

Your best bet is to take your ticket to court and have it thrown out. If what you say is correct then I don't see how they could have any probable cause to suspect it is modified. Other that the intercooler, but there are systems out there that are legally with intercoolers. If you can get the cite kicked out then you don't have to worry about going to the referee...

Just FYI, you don't have to pop the hood of your car unless you've showed or given them a reason to. Just because your car is parked in a lot doesn't mean you have to pop it to show an officer. Don't be a jerk about, politely say no.

Oh and you can probably get this tossed out in court on your own so dont get a lawyer..

By you challenging the probable cause you can eliminate everything that happened afterwards...

They would have to show and explain what the probable cause was, show or have something in writing they had the authority to tow vehicles, and explain why they opened your car without you being there.

The best thing would be if the vehicle code doesn't apply and then they can't really do anything..

I am so fed up with california and this faschist crap, but where to move? What other state can compare to the weather and location...ocean, mountains, great sunshine, not too much rain, not too hot...I'm really struggling on that.


You could have had a perfectly legal Supercharger like the stillen, they did not know what was under your hood until they broke into your car. They just simply have to stop acting like criminals and the only way to get them to is to form an organization that protects our rights to modify our cars.....oh wait we have that, it's called SEMA.....where the hell are these people these days?

so I guess you have no choice but to sue and in this case I say sue their asses off!

Sorry to hear it. Im in the same boat as you. Im now thinking about selling my car because of this BS. They have a task force for import modded cars in my city. I dont even drive my car because of it. This is just a way for cali to make more monies. CARB cost money, smog more money. I know a guy from this site that got the same ticket in SD. He was leaving a car show. Anyway he ended up just paying bail. He didnt know what was going to happen. He waited for the ticket to come and you could pay like 500.00 or go to the ref. He ended up just paying. If I could leave this state I would. Im just stuck here right now! FUGGIN CALI!

i would fight the ticket only on principle. like some have said, it'll cost you more money to get a lawyer.

looking at the pics, there were other cars on that lot. did you know if they were broken into? i really, really think you have a case against the police dept. i read that one of the guys at the meet got the name/badge number of the officers. see if you can get that info and go from there. this is one of those times I wish I carried a camcorder in my car. you coulda videotaped them the whole time. and i swear to you, they wouldn't have said anything about costco management giving them the right to search cars or have them towed. you know, and I know and we all know that line was horse$hit, used to simply intimidate you into opening your hood.

yes, I was told the courtesy notice you receive will allow you to pay the fine. What happens if you get caught next time, I don't know.

if you can edit the original post, I would. No need to publicly say you are gonna try to cheat the system by bribing the smog referee.

Washington or I know Oregon has beautiful weather and Mountains my parents lived there for years and loved it, cost of living isn't that bad either. I don't know if they have any beaches in Oregon though, don't think they do. About you're situation I would try to fight the ticket without a lawyer and then contact a lawyer in regards to your civil rights being violated and suing the police department.

North/South Carolina - Virginia would be your best bet.
