So a Police Officer just entered my house without a Search Warrant!

he has the right to disperse a crowd. thats why he went in(he could say). the only thing he did wrong was not give you a badge number. he threatened to arrest you, eh, maybe he had his reasoning, if not, maybe he felt threatened by your actions. or maybe he just wanted you to shut up

Man... you are lucky...if you get arrested sometimes they will put your azz in a county jail, if the local police department is full of guys like you, and in the county jail you have to hold the soap very hard, if you do loose the soap your little "o" will look like this "O" : )

For something minor you won’t spend the night in a county jail…and you danm sure won’t take a shower in a county jail. Now if you dropped your soap in county jail that’s great for you…..it is totally irrelevant to the thread…………………….we don’t need to know that your azz-hole went from o to O after a night at your local county jail bud.

No not a law student, but I know my rights. By law, I police officer cannot, CAN NOT, enter one foot inside your home without you either asking him to enter or with a warrant. Thats the only thing that bothers me, he knew that

There are so many things wrong with what you wrote (and I'm not talking grammar), that I don't know where to start....wait, actually I do and I've only had one beer.
============
You got a warning. Cop was being cool.
Warning #2
At this point, if you were sober or thinking things through, you should of cooperated and gone downstairs and told your buddies to shut up and go home. If any of them were drunk, you should of told the cop to breathalize them and take them off the road.
After 2 warnings... he was looking for compliance, not an explanation.
The usual position an officer takes when 2 warnings are ignored and someone is becoming belligerent.
Yes, members of the Jury, our defendent did state his "girlfriend's home."
"Yes, your Honor, the defendent did notify me that I was not allowed in his home.. but the residence belonged to the defendent's girlfriend, not him."
Lie #1
Lie #2 - He's believing his own story now.
What, no phone downstairs? No cell phone? What's with the going upstairs? You're lucky he didn't slam you to the ground and let you try on some silver wrist-bling.
Uh, why do you need a badge number when his name is on his uniform? I mean, seriously, how many "A. Lundry's" do you think would be working that night and shift for that PD? What does a badge # get you that a name doesn't?
I believe you just drove through a red light that we like to call "Warning #3"
So, like... did your girlfriend make coffee for everyone as he waited for you to call a few times?
"in time"... what's that like 15 minutes while everyone commented on chilly the air is tonight... or was he patiently waiting for your loud azz buddies to get gone.. or did you sit your living room giving each other stink eye? Or did he just run down to Krispey Kreme during this intermission?
Soooo... they were outside, not inside.
And gave you 3 warnings and was now outside.
Duuuude... remember the warnings? You ignored them, therefore he's now suspicious. Another word for acting suspicious, is to think something is fishy... and you were stinking it up something big.
Yes, you are correct that the supervisor was threatening you as in, "a warning that something unpleasant is imminent"
He didn't ask you if you had been drinking. He was warning (#4) that you would be arrested unless you returned to the residence.
If you had been patient, the supervisor would have come to you to hear your side. But, first, he needed to find out what the hell was going from his officer first.
Oh ya, you are studying law. That could only be taken as a threat that you would be using your knowledge of law to take legal action against the officer, supervisor, police department, and the city or county.
And I'm going to take creative license and flash forward to another post by you:
So, if you are studying law, but you are not a law student..Lie #3?...
oh nevermind. moving on.
You asked who for the lieutenant? When would he not talk to you? You mean the supervisor would not talk to you after you were warned to go back into the house?
You then tried calling the police department when you already had two pissed off representatives standing outside discussing your situation. I am not sure they just hung up on you, it's probably that they just couldn't solve everything to your satisfaction at that moment, over the phone and had to move on to other more urgent issues currently on hold.
Uh... if you had headed the warning, you and your girlfriend could be enjoying a quiet evening at home, without your loud friends and no police.
hope you pay more than a dollar... and gonna assume you are not in CA, since its sounds like State troopers vs a city PD.
No, you were warned (repeatedly) without getting beat down, cuffed or maced or tasered....and you ignored it.
Good thing you don't have L.A. Sheriff....
It would have gone like this:
Deputy: Sir, your friends are being noisy. They need to stop and you need to clear out this party or you will be cited.
You: I've got nothing to do with those fools. This is my house now get......... uuuhhhh, man these lights are bright, even with my eyes swollen shut and how come this bench seat isn't upholstered? Man, I wish I could itch my nose, but my new bracelets just won't let me.
You weren't pushed, or touched. But you did come awful close.
You did get help, you got a supervisor who you insisted on interrupting.
It's curious that you didn't post whether or not he spoke to you, or they both just left. If that's the case, you were probably lucky they didn't you give you another chance to represent yourself.
Nope, not a clue.

My girlfriend and I decided to have a few friends over. In time, It did become a bit noisy in which the San Marcos PD was called and came to give us a warning. So we decided to send everyone home.
About 10 minutes later the SMPD returned, same officer "A Lundry", stating that we are being too load, we than showed him out 4 guests total which came to the front door and he than warned us
that our previous guest, whom had left, are being load and noisy leaving and that we are going to be ticketed or fined,
I explained to the officer that those guests are not our responsibility.
The officer than walked up to me in my face,
inside my girlfriends home.
I told the officer that he is not aloud in my home with out a search warrant.
Lie #1
He would not leave from inside my home
so I ran up stairs to dial the police station and to write down information and hopefully get my proof on camera.
I came down stairs and asked for his badge number which he would not give me,
then threatened that he would arrest me if I didn't stop asking him.
I called the San Marcos dept. a few times until they verified that they were sending someone down.
So in time,
his "supervisor" came out and would not talk to me saying to "get back in your house or I will arrest you".
So now I have a crazy police officer that entered my home with no search warrant
which is against the law without reasoning or suspicion
and his "supervisor" that is now threatening me saying "I'm going to give you a drunk in public and arrest you if you don't go back inside".
I told him that I had not been drinking and that I am studying law and know my rights.
If you had been patient, the supervisor would have come to you to hear your side. But, first, he needed to find out what the hell was going from his officer first.

No help!!
We all know that we pay tax dollar for the States Finest in our protection,
but in this case, we were threatened in our own home,
Good thing you don't have L.A. Sheriff....

we've been pushed aside and are not receiving any help.

Anyone...know what to do?

^Damn, you got good time management. County Jail aint that complicated, been in one for a month cus I stole a car for fun when I was young and dumb. I aint pround but i'm glad i'm alive cus I got no tats put it that way.
Word of advice, relax around a Cop. Cus it only gets worst if you don't. Trained dummies only know how to "act/command authority"
