I'm an attorney, and although I have no intention of representing you, or giving you direct legal advice, sorry, but had to put that in there, I would ask/write down some questions that need to be answered, such as: How windy was it that night? I'm not an expert and would not just assume a 20-30mph wind would be strong enough to blow over a several hundred pound motorcycle. Did you, or anyone else, see him park it for the night? Did he park too close? Was he under the influence? Is his side/center stand defective? Does he even have insurance? Did anyone happen to witness the accident? Did he park correctly for the conditions. For example, if the slot was uneven, did he park in the correct manner, I.e., not nose pointing down the hill. In other words, there are a lot of things to think about before you or anyone else just assumes that they know how this accident took place and why, and I would be especially wary of adjusters as their job is not usually to ask these important questions, but to make assumptions that are often unsupported in order to have the deal come out in favor of their particular employer. If you deal with one, be careful and watch what "facts" they assume to be true without any support whatsoever. If you find one doing that, challenge them to support their claims with evidence. Just because someone says something does not make it true. Best of luck

With that amount of damage your comprehensive should take care of it.Your deductible is just to high for collision your deductible should be 250.00 and for comprehensive it should be 100.00.

 

I think you would need hurricane style winds to knock over a bike unless the owner had the kickstand on an area higher than what the tires were on.

There is no harm in following up with your insurance company. You can get the info from them without filing a claim.

 

It would have to take some serious wind to knock over a motorcycle. Odds are he didnt extend his kickstand all the way out or its jacked up. You take any pictures by any chance?

Only thing I can see is to take him to small claims court. Bottom line is he is responsible to make sure he parked his bike correctly, and unless there was serious wind that night, he would be responsible. Only time I can see an act of god could come into play is if there was a hurricane that night and it threw the bike into your car.... Only thing Im not sure about is if someone else came along and pushed his bike over into your car... then Im not sure how that would play out...

 

If the guy doesnt want to help pay for the damage, push the guys bike onto the ground and call it "an act of god".
