I was F*&%#D, dont trust dealers most of the time :(!
On July 28 of this year I visited my local nissan and ordered me a performance model daytona blue z. One of the main reasons I ordered my z before the actual release date was to have it for the holidays. All seemed well so I went ahead with the order. I was aware that the presale program ended first of July but that did not bother me.
A month and half has passed so i decided to call my local salesman to check the status on my z. Basically I was told that he knows nothing but you will have it before the holidays. To possibly find out something myself I called Nissan North America. They also could not help me at the time since my z was not classified as a special order. The representative did check a few things but no sign of my z anywhere. To double check I recalled my local nissan and talked to another salesman. I just wanted to make sure that my order has been placed with Nissan b/c myself nor NNA could not find my car anywhere within their system. He said dont worry your order has been sent over I personally remember sending it over with our stock list.
Its now November and my local nissan has not made the first attempt to keep their customer (ME) satisified. So yesterday I tried NNA one more time and talked to this representative named DAVID. David's current job is to track the order status of Z's so I am sure he will tell me where my z is. After a 5 min conversation he begins to track my z. He starts with the month of august, my z is nowhere to to be found on my dealers order. On to September, nope nowhere to be found! Now to october, "well Andy, i see track daytona blue but thats not yours." I am basically in a state of shock right about now. Now to the month of November. There it is your z is on this months order list. YES NOVEMBER! I placed my order with my nissan in JULY to assure this car for the holidays and its on November stock list. WTF, becuase of this nonsense my car has a ETA of January 21st. Just imagine how i feel now!!!!!!!
My point is do your research if you ordered your z after the month of august. If your dealer tells you that you may have it by Feb or whatever CHECK INTO IT with NNA. I dont know what happend with my dealership but thats not the point. The point is they basically screwed me over so do not let this **** happen to you.
Who knows when I'll receive my Z but thanks to NISSAN my holidays are ruined! Just do your homework guys! Its late and i am tired so no spell or grammar check so goodnight!

Kinda funny, I had an order get screwed up a few years ago. I ordered a 4wd Tacoma extended cab V6, 5spd. I also ordered the TRD supercharger which is a dealer installed option. I waited two months for my truck. When it came in the dealer called me, told me they needed a day to get the supercharger installed and then I could come pick it up. 1 hour before I was to take delivery the dealer called me on my cell and told me that they had accidentally ordered me a 4cyl instead of the 6cyl. No one ever noticed that they had the wrong truck until they gave it to the tech to install the supercharger only to find no V6. I was so pissed I screamed at the salesman so much I thought he was going to cry. It's kinda funny now but I was pissed at the time.
screw it, get your deposit back, go find a brand new one on a lot and you can find them, I did. had it for 3 weeks now, walked in, drove out. MSRP.
this whole preorder thing is over rated.
I bet he took your order, but he can only order X amount a month, and had already promised many orders before you. go find a dealer that isnt selling so hot, they still get a few Zs.

Well see this is the thing which I am worried about.
I ordered the 9th of Nov I am promised a car in Feb. But guess what. Dealer can only order 14 cars per month + he has 38 orderes already.
If you do the math that would mean I am not getting my car ORDERED till feb + 3 months wait.
Whats sucks even worse is my deposit is non refundable and I actually need a car since my current automobile is ready to die.
Dealers love to lie and cheat. Wish you could go directly to the manufacturer.
I wish I went to few other dealers I am pissed at myself.

Keep things in perspective, man. Getting sick could ruin your holidays, a terrorist attack could ruin your holidays, but not having a Z? In the scheme of things, this is small potatoes unless you let it eat you up.

At this point, since I knew that my build date was in Oct. with expected delivery in late Nov./early Dec., and since I knew that folks usually get their VIN appx. one month in advance, I knew to expect it sometime early November. Furthermore, I was more sure about getting my VIN early Nov. since folks were getting their cars earlier than expected. Finally, folks who ordered at the time I did with similar order number (starting with "V"), started getting their VIN's late October! So this nailed it for me! I had to get my VIN end of Oct./early Nov..
6). After I got my VIN in early Nov., I knew to expect my car to show up in inventory late Nov./early Dec.. I was actually given a estimate of delivery on Dec. 13, 2002. However, once again, because I was reading this board, I knew that folks were getting their cars about 2-3 weeks early. So I expected my car mid-late November. Well, my car showed-up in inventory on 11/15/2002, and I expect the truck to travel from S. CA to N. CA to my dealer in Shingle Springs in 1-2 days (assuming it does not stay at port for some time). So my dealer should give me a call around 11/18-11/20 (it will tend to come around the 18th if not delayed in port and around 20th if delayed).

Maybe it is my fault yes. But should the dealer be able to screw me even further. I think this is the moral of the story. And applies to what Buzz350z was saying.
It will certainly not ruin my holidays but that feeling creates doubt in the back of my head and + the fact that I put down $ 2500 which is non refundable. In my case.

Ask people in the car business and they will tell you, the dealer must give you a refund even up to and including the day of delivery. They have no choice. Think about it, if you do not take possesion of the car, you have nothing and they got your money. Just tyell them you cannot afford to buy it such as you lost your job etc. It idoes not matter, they legall y have to give you a refund. They will if you push iot because they know they would get killed in small claims court.

I'd let everyone who has you on their Christmas list know about it.
You could look at it as a way of getting lots of Z goodies in your stocking. You know, ball caps, key chains, Nismo bumper cover, Brembo breaks, etc.......

I have a purchase agreement and order form. Which means I can say that I was promised the car in Feb but that agreement was broken by the dealer.
Also in the American law system. A spoken agreement goes as far as a written agreement. Isn't that how it works?
I personally will not get worried about it. I just need the car by February. If the dealer doesn't give me my customer # in the upcomming week or two I will start going to other dealers.

However sometimes dealer doesn't necessarly tell you the truth. Example in my case would be.
"I just spoke to the GM and your car will be here by Feb if you order now....the order will be made sometime in December....etc"
Should I automatically belive he is lying? I personally didn't know there was so many orders ahead of me I just overheard another salesman talking about it.
Having said that I am not stupid I know exactly what they are trying to accomplish by a NON-Refundable deposit. They want to secure the deal.
However you have to realize I am ready to buy the car. I change my insurance already spoke with my banks on the loan.
When I went to a smaller dealer that same day he told me they had not 1 Z to look at on the lot so hence I went to a bigger dealer.
Have you spoken with the Sales Manager about getting your deposit back? They breached the agreement by not placing the order for several months. They should not have entered the agreement if they knew they would not be able to place the order for months. If they failed to place the order because it "slipped through the cracks", their negligence was abreach of the agreement. If you politely but firmly explain this and ask the Sales Manager for your deposit back they will probably give it to you under these circumstances. If the manager refuses you can mention going to a lawyer or the District Attorney's Consumer Protection Deputy, the BBB, getting Nissan involved, contacting the local media "troubleshooter", hiring picketers at $7/hr. to express your opinion, to do the research and identify the owners of the dealership and speak with them, and other tactics which work in your area. I doubt the dealership wants to go throught the hassle and possible loss of good name in the community. The most important first thing is to be polite but firm and to speak with the manager. That should do the trick. Good luck.

jimflash: Yeah that sounds like a wise idea. Its bascially boils down to what I said before in my case. I don't want to go into a dealership and start World War 3.
Than again I might be completely wrong my dealer could actually be telling the truth. I hope.

If not, then the car won't be ordered now and I would get in writing a written statement from the SALES MANAGER when the order will be placed. I they refuse, search for another dealer willing to sell a Z at MSRP off the lot (check milleage and ask how long car has been in lot and if anyone has driven it).
As for getting you refund back, I know for a fact that in CA refunds are refundable. My dealer initially tried to tell me it wasn't, but I told him it was CA law. So I would check your local state laws regarding this issue.
