Can you sue nissan for this?

Default Can you sue nissan for this?

A month or so ago my car went into shop for leaking oil. After about 4 days they figured out it was coming from crank pulley and housing (seal was damaged and crank pulley was cracked) so after 8 days i finally got my car back and it drove just as good as before, and didnt leak oil. About 4 weeks after that I installed a UR crank pulley, but come to notice

the pulley they elegidly fixed, its CRACKED, bad and i mean REAL bad.....

On the statement I got (cant find but sure I could get a hold of) it says they replaced the crank pulley and seal to stop leak, they couldnt reproduce my pulley for warranty purposes cause they send the parts off to get it all covered or whatever....

Now this has to be the shadiest thing ive ever seen from a dealership, and potentially disasterous possibly

Yes. You can file a law suit against anyone for any reason.

yeah but would it be worth my time lol, i dont wanna waste my time if theres no $$$ flow in the end

ye..u can sue them for that. They failed to replace the crank after it has been cracked. They also wrote in the statement saying they actually replaced it. U can sue em for endangering ur life and luckyly u inspected the crank before some serious damage could occur.

Yeah but would it be worth my time, cause heck id love to get about 15k out of them (and thats actually not a lot to sue for id probably sue for more) but id like to do that so i can TT my car and do completely built block and push 450-500 hp haha sorry went off dreaming again.

But anyways would it be worth the time and effort to go against the company with that one statement and the pulley (i kept it for any occasion nissan effed with me then id bust it out)

umm... im no lawyer but i think u should consult with ur lawyer and ask him ur chances of suing them! As long as u have the statement they gave u, i dont see anyway u can loose. Good luck bro!

pretty sure you would only be able to sue them for re-fixing it (and thts only if they refuse to fix it properly). Now if you crashed and got injured from there mistake then you could sue them for $$$

You might get the cost of the new pulley in a settlement, then you would just be out the lawyer and court fee's which will probably run you into the thousands. Good Luck.

see considering im going into law i knew about court fees and lawyer fees (even though hes a family friend) thats why i was wondering about the $$$ possibilities... ill be going into medical law so im like on the other side of the fence is why im asking

somebody messed up your car, maybe you should consult a lawyer.

Say you had to replace it yourself... The only damages are you new pully and labor (because you couldn't trust them to "fix" it again), and possible punitives...

Hardly seems worth the effort to me. If you talk to the GM, maybe you can get them to pick up your pully/labor tab... Threaten to report them to NNA. They are the real people ripped off. They paid for work under the FW that was not actually performed.

+1 You can't receive compensation for something that might have happened. Only for something that did happen (i.e. failed to replace pulley).

yeah but considering the tab was really like 300, 200 for pulley and about rest for install (my mechanic would help me get more $$$) thats not to much worth it, and considering nissan will probably never respect me or be nice to me again, like sueing a resturaunt... they dont want your business again after considering what you could say/do

problem with lawsuits like this is drags people like me into jury duty

I would just take it back and let the service manager know what happen. They should take care of it as the service manager should inspect it to make sure this time around it gets fixed properly.

Ah I didn't see that... Well you could go back to the service department and ask them to refund your money since they never fixed the pully like it says in the service report and then show them the cracked pully, just tell them you had it replaced at another shop because you didnt trust them.

I suspect that Nissan has staff of lawyers whose primary job is to see that your suit never gets to court. One of you will run out of money first. And I have a strange feeling that party will not be Nissan. Sorry.

Yeah, thats about it these days. I think shady people should have to pay a penalty. That way they might take a second thought about doing such things.
