Default What would you do. . .?

A few months ago, I purchased what was supposed to be an Injen exhuast for a 350Z from someone on this site. After a handful of delays and excuses, I finally got the exhuast delivered. After some more delays and excuses, I finally got the hardware to install it. When I went to have it installed, the shop called me and informed me that the exhaust he sold me was too long and was really for a G35. When I called the seller, he said that the exhaust was on his car and that since he had a body kit on his Z, he didn't notice that it was too long. I find the story hard to believe since there is no way to mount the exhaust on a Z without making some serious modifications (which were NOT made on what I received from him). I have called the seller and left him a message. I have also pm'd him. So far I haven't received a response. I even started a thread on this site asking him to call me and it was locked by a mod (I pm'd the mod asking why, but I haven't received a response from him either).

I'm sure some people will tell me to quit whining and move on, but I'm sure some of them would think differently if they were in the same position. I just want this guy to make the situation right and at the same time, prevent someone else on this site from getting ripped off by him.

So what would you do?

If you paid with Paypal dispute with them. If you paid any other way then your SOL. If you used your credit card with paypal and paypal won't help then call cc and charge back

Yeah, I wish that I had used Paypal or something like that, but I figured that I wouldn't get screwed by another Z enthusiast. I guess I figured wrong!

You have little recourse. The exhaust was sold as is.

I agree with the "as is" part, but it was "as is" for an intended use, i.e. 350Z and not G35, so in my opinion, it falls under breach of (verbal) contract:

"breach of contract
n. failing to perform any term of a contract, written or oral, without a legitimate legal excuse. This may include not completing a job, not paying in full or on time, failure to deliver all the goods, substituting inferior or significantly different goods, not providing a bond when required, being late without excuse, or any act which shows the party will not complete the work ("anticipatory breach").

I would call your credit card company. I have capital one and am automatically covered for internet purchases like ebay regardless of wether or not I used paypal. I got screwed out of $380.00 for 12 dozen golf ***** one time. Capital One did the charge back to my credit card and then they went after to guy to get their money. True it was probably sold as is but it obviously does not fit your car. Id give it a shot at least.

He should have more class than that. He sold you a G35 exhaust and said it was a Z exhaust. Yeah, they're similar. But that ain't good enough.

Keep trying to get a hold of him. Threatening internet/mail fraud is a good way to get some results as well. Search USPS.com for what to do. Since I suspect that the exhaust was shipped across state lines, that makes it worse for him.

This is what the iTrader Rating system is for. If he sent you something other than what he advertised, you need to leave negative feedback for him to warn other members.

As for why your thread was locked, you need to remember that this forum has 10's of thousands of members. If all of them used the General forum as a personal message board, bumping their thread to keep it on the front page.....well, you get the point.

I agree - this guy has been around here for a while, so I assumed that he'd be less likely to screw over another member.

I'll try to give him a call and then see what happens from there. Otherwise, I guess I have a G35 exhaust for sale!

I did leave him negative feedback, and I appreciate that we have the option to do that.

I started the other thread in hopes that he or someone who knows him would notice it and give me a call. Since phone calls and PMs didn't work, this was my last option. I do understand your point though, and I appreciate the explanation.

You can certainly fight this thing based on ethics and principal, but at the end of the day its not that hard or expensive to shorten the exhaust. Depending on how much time your willing to spend on this I would just shorten it.

Read too many threads like this....I'll never buy from another member from here or anywhere else. I'll just half'ta pay full price
