Nissan would likely say yes. The law says that if you break anything that it has to be shown that your modifications caused it.
Probably a lot of lawering involved in proving the cause and effect if you do break something.

They probably wont even know its there!
Unless they can prove that the modification was the direct cause of the problem it does not affect warranty.
If you are installing your lower plenum, drop a bolt down the runners, finish the install, turn on the car... your buying that new motor...
