Dealer screw up
Outragous...I take my z in for an oil change this morning. As I am driving up to the service bay the tech pushes the button to close the overhead door. He didn't look! Clips my car just in front of the rear hatch. Causes a few small dents but shatters the rear window. Of course there were no saftey devices installed to prevent this.
Get this...their insurance company refuses to fix because I was driving the car into the bay. Dealer offers to pay my deductible. OK...but it wasn't my fault! The dealer/owner should have it fixed but is ignoring me. This is crap. If they don't make it right so it doesnt' cost me I will be calling a lot of people and writing letters.

I HATE those doors, they are so careless when opening and closing them, I noticed at my old dealer that the guy would walk over and close it without even looking to see if anything was in the way!! Lots of luck on getting her back to her original shape
Small claims court - not your insurance.
It was their fault letting you drive the car. It was their agent who lowered the door on your car - there should be zero costs to you. Sue them for repair and court costs.

You should leave your car there! do not leave with it..... do whatever it takes to have the dealership pay for this! claims court or go above the dealership and contact their insurance if you have too.

Call your insurance company!!!
If the dealership is responsible, (sounds like it to me), YOUR INSURANCE COMPANY will get it settled.
This is one of the benefits your insurance company provides. Don't hesitate to use it. You pay for it in your premuim.

well that sucks. Is it normal for your dealer to let you drive into the bay? If they tell me to, I refuse to do it for this reason.
I think you have a good case for the dealership to pay for it. Like the person above said, your insurance company should help you out with this.

This is called Garage Keeper's Liability Coverage, they just want to dump it on you.
I would first notify your insurance company and get this incident reported.
Here are your options, make a claim with them, or make a claim with your own insurance company and soak your collision deductible under your own insurance policy, get the Z fixed, then your insurance carrier will go after the dealership. Your Z is fixed and you will get your deductible back when your insurance company recovers.
Then I would hit the dealership pretty hard and advise them that they have the burden to ensure that they were not closing the door without confirming that you were advised to enter that bay. They operate the doors they have the duty to ensure that a customer is not injured do to any negligent (half-***) actions of their employees, this is called a business-invitee situation. In other words, you were invited to their premises you were lawfully allowed to enter (and since they call the shots, tell people where to park their cars, where to move them, what they can do ) they have complete control, even a higher duty of care considering vehicles are involved.
If your neck and back hurts, go see a chiropractor or a physical therapist and pursue a bodily injury claim get an attorney to represent you and then make a demand for compensation for your pain and suffering.
Next time you go into the dealership they will be sweating. I am sure after a nice little settlement check your car dents will all go away, maybe even pay off the rest of your Z!

Thanks for the advise...I did turn into my insurance company. They essentially said what ManicZ said. They would attempt to recover from the dealer's insurance. Libery Mutual rep con't believe they initial decision by the dealer ins co that they wouldn't pay because I was driving the car. The dealer did say he would pay my deductible of 500 so they are already admiting some fault. I'm going to go see the car this morning and get the estimate as Liberty Mutuals repair shop already has the car. And picking up a rental. Oh and there are no STOP signs or saftey systems on the doors to reverse the door like we all have on our home doors...si that stupid or what.
Then I am going to talk to the service manager as I have known him for 25 years. He didn't sound like he was very happy with what the dealer was telling him to do. I'm going to see if he will tell me what they told their insurance company although that is a matter of record.
I am also going to ask for the 500 check they offered for the deductible. As they say...show me the money!
Then I am going to wait for the check to clear and call the Nissan executive I know in the CA corp office. He ordered a 2nd set of front tires when I was having feathering troubles...when the dealer and the Nissan customer service people said no.
In any case..even if I eventually get this all fixed...it's shows me this dealer doesn't really understand customer service. Oh and my neck is fine! I would not do that as tow wrongs still don't make a right in my book.

Again, get the advise of your insurance agent, but normally, acceptance of that check will release the dealership from any further liability.
