I'm not sure about NY but here it would have been the Cherokee drivers fault, if the Maxima was at a complete stop. Personally, I wouldn't worry about the ******** cop, too many of them! I'd call your Ins to make sure they know someone hit you, and if you have a report #, cops name, or any information on the other drivers give that to the Ins as well. You pay for them to cover you, let them work for their money. As far as a rental, put it on your dime and get reimbursed for it later, keep it modest, I think most are around $30/day.

one of our friends in the preceint pulled a copy of the report this morning. the guy in the cherokee is supposed to call us back today. and the maxima was at a full stop for the amount of time i was...

im insurance company told me to sue the maximas insurance and then their insurance will sue the cherokee for my damages...

Update

well i was told i have to go through the jeeps insurance...

heres BAD NEWS... he has a $10,000 policy... the maxima was an '07 which means i doubt the interest on the car was even paid off yet alone the value so including the damage to the maxima and my car im sure its roughly $30,000 if not more closer to 35-40k...

so ill get a maximum of 3 grand from his Geico (if im lucky) and the rest either comes out of my pocket or my insurance thus possibly causing my rate to go up.

i mean, WHO THE F*CK ONLY TAKES OUT $10,000 INSURANCE POLICY THESE DAYS?!?!?!?!?!? most cars on the road are over $15,000 mine being over 30grand...

and he has no assets to sue him for. he lives with his mom (49 years old this guy is), his fiance owns and insured the jeep so i and the driver of the maxima would have to go after her and i doubt we'll be able to get anything from these poor *** slobs.

im so stressed you have no idea... least ill have to pay is my $500 deductable... $500 which i dont have at my disposal at the moment. that 500 bucks could have been put towards some sort of mod to my roadster....

Thats freakin ridiculous. I cant believe how much of a bum that guy is, 49, living at home, aand his fiance paying for all his sh*t. HE has to pay for your damages, since his insurance won't cover it. If I were you, I'd sue anyways.

i spent 15 mins on the phone with his insurance today at work to give my statement...

his insurance was on my side...

for $4 more a month he could of had a $50,000 policy... the woman from his insurance said hes off scott free since he was just the driver... that her insurance has to do the payout of 10 grand between 2 cars (one totaled 07 maxima and my rear ended roadster)

my guess is he was such a risky driver he couldnt have his own policy.

im gonna rip his throat out if i ever see him for all the stress and BS and money loss he has caused me for his own cheapness and stupidity


and theres nothing to sue him for... he doesnt own anything.... no car, no home, what am i gonna get? his sock drawer and some old sneakers? its not worth my time to get a lawyer to garnish his $5/an hour salary paycheck till im paid off at age 90

Gawd lack of insurance and underinsured motorists **** me off. Especially since I have 100k/300k. It's ppl like that jeep owner that makes me have uninsured/underinsured motorist coverage. It pissed me off that I have to pay more for insurance for those that decide not to

yea... when i was 16/17 as a new driver i had a million dollar umbrella policy under my parents insurance. now at 21 with more experience im at a minimum of 100k policy... but 10k?!?! im still shocked they allow that... either way , for the inconvienience this is causing me, if i do i ever see this man (lives 2 mins from me) im gonna drop kick him in the back of the neck

its a good thing i lent him my cell to call his home, otherwise we wouldnt be able to reach him since he has 3 diff adresses he goes by...

he never reported the accident to his insurance so they have been callin him these past 2 days with no luck of reaching him so they will send him a certified letter and so on

i dont get why you are going through the other person's insurance that makes no sense.

regardless if it's your fault or not you go through your own insurance, they pay to fix your car and your insurance company goes after the other folks.

Why do you pay your insurance every month? Seems like you're doing the work for your insurance company and you're paying them monthly for no reason.

i have no choice but to go through my insurance now... his insurance would only cut me a check for less than 3 grand since he has a 10k policy and totaled another car. so i have to use my insurance and let them subrogate through his...


now i have to have an adjuster from my company go there and do their estimate... my car is already being worked on... i have to order a new exhaust on my own and then get reimbursed for the money i laid out

i think im gonna go with the Invidia N1 or the topspeed pro n1 since theyre pretty much the same one...

ay anthony.. what school did u go to? ur name is really familiar i went to ward melville right down the rd from ur accident...

whats funny about this story is that my friend Joe Billa ( he has an evo 9 ) picked me up that night around 6:30 and mentioned that he saw some douchebag ( you lol ) get hit pretty good he didnt mean any hardm when he said that u know how people get when they see smoething without knowing what exactly happened hah :P

Anyways... he mentioned ur accident i was like oh crap im gettin ready to get one too and he said he had seeen ur silver z and the max all fawked up pretty good.

joey ballz seen me and didnt call me to ask if it was me or not??? what an ***. im good friends with billa. im gonna call him today , havnt spoken to him since before i went to FL.... i seen an Evo go by too but didnt twice of it bein joe. lol tell him atleast i didnt smash my rim into the curb in the rain.....

The good news is that he has a little insurance which is enough to cover your deductible. Let your insurance company handle the rest and get your car fixed.

I totalled a new RAV4 a few years back when these freakin people ran a redlight in front of me. They weren't even citizens and had NO insurance. My insurance coughed up everything and my rates are unchanged. There's hope. BTW I have Statefarm and live in FL.

Yeah I can understand why Anthony was trying to avoid using his own insurance. Any time you file a claim and they have to pay out, there is always a chance that your rate might go up. It doesn't matter whether it was your fault or not, it's ultimately up to the insurance underwriters. You just hope that the reports clearly state that the accident was someone else's fault and you were a victim.

Anthony, is New York an at-fault state or a no-fault state? I live in PA which is a no-fault state, so you basically have to avoid any car altercations at all costs. 5 years ago my sister's car was parked along a street and she was inside at a friend's house when some moron rear-ended her parked car doing about 50 mph. After everything was straightened out and her policy renewal came around, they increased her premium by about 200%. Hopefully New York treats you better.

Good luck with your car bro. Make sure you keep track of all your expenses (receipts, etc.) so that you can try to get reimbursed for all out-of-pocket expenses.
