I know this is late but I hope you have or will do the following:

1) Get a lawyer
2) Go see a REAL back doctor instead of chiropractor like a orthopedic surgeon, neurosurgeon, and.or a physical therapist.

Get a lawyer!

Do not deal with the insurance company without a lawyer.

The best person to figure out the full extent of your rights and possible payment is a lawyer. Why try to fight with the insurance company on your own?

A good PI lawyer will tell you exactly what to do from here on out to maximize your recovery -- what doctors to see, how to record your pain and suffering, who to get to repair the car and what their insurance is obligated to pay.

I been rear ended three times in my life. You'll feel it tomorrow. Hope this isn't true in your case ... But, it has been in mine every time and for good medical reasons .... shock, stiffness, swelling to name a few.

The only thing I can recommend is Chiropractor. After doctors and years and years of help. I still have a hard time sleeping.

It is really difficult to get a settlement nowadays on such. If they see you doing any work for anything your out of your case. The problem isn't that you might not be able to use your back. It's how much it hurts getting up from the arthritis that set in later in life. Chiropractor helps a lot.

Reason I'm up tonight is I did some home repairs today and my neck hurts right now and I can't sleep very well anymore. I get a max of 4 hours of sleep a day and if I sleep more than that my neck and back stiffen up.

Mountain bike riding and swimming help a lot.

I wish I could have sued and got some money for one of those wrecks. But, the lawyer just won't take them anymore.... no money in them.

I mean really, I hurt and I shouldn't have had this trouble .... Whine

But, you carry on and do the best you can.

Bad things do happen to good people.

I'll disagree with you there. I haven't been able to get rid of the pain except by going to Chiropractic, Massage, Acupuncture. I had punched nerves and numbness in arms, hands, and neck. Doctor couldn't do anything.
Doctors just want to medicate you covering the problem making you loopy and still in pain.

Pain is the body's protection. You keep hurting yourself further on the drugs and wonder why when your off the drugs why you hurt more than ever before.

My brother in law has had many surgeon that messed up his back after his accident because the drugs weren't working for him. He has gone through loads of extra lawsuits trying to straighten that all out. His recovery has not been as good as mine and he was only in one of the three accidents I've been in.

On the plus side. Had I not been rear ended three times I wouldn't be exercising and in as good a shape as I am now. Exercise, and Chiropractor ... But, it has to be the right one. Like any doctor ... you get good ones and you get bad one.

Enough rant ... hopefully this helps someone not to go through the pain I go through daily. My only problem is stiffness after sleeping 4-5 hours now or if I work really hard in awkward angles. Painting overhead today.

Good, idea. I'm not saying Chiro is the only way to go. But, I've been around the block and no number of doctors could figure it out. Thousands of $ in beds, doctors, meds, etc... Chiro / hot tub / massage / exercise was the key for me.

I had hoped that a pill would do it for me ... Ha, no such luck.

SUE. do what i should have done when i got sideswiped in my spec V. didnt do anything because it didnt hurt at the time. 6 months later its kind of hurting still so i get an xray and behold! i have a fractured back right smack dab in the middle. (cant remember which vertebret((spelling?)) this was back in 03...i have not slept a full night since then and i constantly have back pain and nothing to show for it. thats all i gotta say. good luck!

edit - not to hijack...but is there anything i could do this far from the accident? probably not..just wanna know.

yeah..it really sux. i cant stand for very long without my back starting to hurt. cant walk to long either. forget about running too lol. plus, every once in awhile for no reason at all...ill get a really bad twinge that takes my breath away and makes me have to sit down. and that usually stays around for a couple days before i feel better. its ****ty...and like one of the other guys said...the money wont take the pain away but at least you dont come out behind. i had to quit the job i was at when it happened and i cant do the work that i went to school for (i went to uti to be a automotive tech) unless its something like tuning or diagnosing vehicles...so that screws me too. but blah blah blah you get the idea. *whines a little more*

Thanks, I might just do that. It's less than one Chiropractic visit. So, it's worth a try. I hope if I get started on this stuff and like it, the company doesn't go out of business. That's always the fear with advertisements like that one.

Then again, it might come to my local Walmart right after that for $10 a bottle. Who knows?

Thx

Well things are coming to a close. The Insurance company and I are going to sit down and talk about a settlement within the next week. My back is feeling fine, just a couple of pinches here and there but very minimal. My Z is running normal. How much should I negotiate for? I have to take into consideration that any bad movement could reaggravate my lower back, pretty much I'm going to have a fragil lower back from now on.

You rear-ended him and are calling yourself a dumbass for tailgating..? Am I reading this right?

you're reading it wrong. The last accident I had was back in 02 when I rear ended somebody else.

This time someone rear ended my car.

Did you get a lawyer? I hope so. I am not one of those people that says to sue everyone, but in some cases you really need to. This guy didn't care, didn't even ask if you were ok, and as a result of his incompetence and impatience to get to the lake you could possibly spend the rest of your life with problems. I would talk to some friends to get the name of a good lawyer, and at the very least talk to them before you negotiate with the insurance company. That's my 2 cents.

So the insurance company called me yesterday to see if I wanted to settle and I said sure. We spoke for like 15 minutes and from the get go they offered me $500. They mentioned they had paid me my wage loss of $1250 so they could only offer me $500 more on top of that. And I said HELL NO!!! I explained to them the job opportunity's I missed out on, the activity's I had to put off, the things I can never get back because of all this aggravation. So we went on and on and I explained that If I re aggravate my back their not going to respond, so I told her that I have to pay out of pocket for those expenses.

So then she offered $1000 and I said no. She asked me how much I thought was suitable and I said $3000. She said she would meet me halfway at $1500 and I said no, $3000. She said the most she could offer me was $2000 and I said, OK, that sounds reasonable.

I feel a whole lot better and my car is running great. So today she's coming over to my job to hand me the check and have me sign some paperwork. Wat u think?
