i can't believe you even let it go on for 6 months. You must be a very nice guy or something. I would of made my point clear and got the car fixed within 1 month of bringing to the shop and that's pushing it.

Yeah the only thing was that theyve worked on my car before, and did a damn good job. Actually, my friend that works there did it, but regardless, it was still run by his boss. Only reason i let it go on so long was i guess because ive been riding my bike and i have other cars to drive, so it didnt bother me as much as it shouldve. But, i do realize that its getting ridiculous, and it was just the info that i got from my friend the other day that pushed it over the edge...

6-8 weeks max for a shop to fix a car. I've dealt with crap shops before and thats just ridiculous. If he can't pay his bills he really shouldn't be fixing your car, if he messes up do you think he'll honestly fix it?

+1 on not giving the check to the shop prior to the work being completed. Order all of the parts yourself, at least the major ones and pay after its completed.

With regards to your situation, work with the Insurance company and look at retaining a lawyer if you cant get your money back. Since some of the work has happened, lets hope its not going to be to hard.

I'd make sure I call the insurance company before I call a lawyer OR DO ANYTHING, its your insurance company's money also I'm sure they (your ins. company) have lawyers for this type of situation.

+1 on contacting the lawyer and insurance company. Contact Insurance, the agent, etc. and see what they have to say first like the people mentioned above. Usually your insurance company has a duty to protect you from stuff like this happening. Also check to see if your state has consumer protection laws. In Texas if you are a consumer who seeks services such as a body shop and then they mislead you in anyway knowingly, and you suffer damages, then you are entitled to all economic damages that flow from it such as the value of the rental car for the time that your car has been out and you also get attorney's fees. Your even entitled to have your damages tripled if they find it was knowingly and intentionally.

why waste time with a lawyer...your insurance company has them...call your adjuster and tell them whats going on...as soon as they tell the shop to start paying on the rental they will start working on the car

I think that would be considered fraud or misappropriation of funds. Also have you been keeping records of your visits or pictures of the car with time stamps on the pics? Im like the others, contact the insurance company, file a claim with BBB, and get a statement from the workers. I would then pull the car out and take it to a legit shop. That way you know its out of harms way. Then i would tell him that i wanted to see an itemized list of parts he ordered, get the purchase order numbers and where he ordered them from. Document document document..
