You're saying that your insurance company does NOT want to honor your claim? What kind of insurance do you carry? Do you not have collision?

So how far out were you from the curb? The front end of the car must have been sticking out for the drunk to nail it like that.

Get the copy of the police report. It will show all the measurements of the point of impact.

Imagine this, if your car was indeed sticking out into the street and a regular driver hit it, you would probably be at fault. Now a drunk hit it, I really don't know if that changes anything, but obviously your insurance company believes that both of you are equal participants of the accident.

Lets say you were driving and rear ended a car and that driver was drunk. Is the drunk driver at fault simply because he or she is drunk?

So the question is, how far were you from the curb? If you were really beyond 18" from the curb, it'll be tough as **** to fight the insurance company. Try calling a traffic attorney and get some advice.
