This sounds like a simple case of misunderstanding, that was taken much further then it needed to be.
im sorry i meant the sheriff. thats my bad, and they wouldnt release my car to me and the sheriff helped to make that happen because i didnt approve the work they had done i technically dont have to pay for it. they stated i couldnt have my car because there was a balance on it thats why i called the sheriff. he knew the law alot better then nissan did, thankfully. and to a previous poster, i never even said maybe to the 30000 mile service i gave him a flat no, so idk where he would possibly get a yes from that. idk all said and done and i came out ahead so...

Only due to you not signing anything is the reason you got the car back. Cops can't do much but make reports for small claims court. Sure they can try to flash the badge around to an un expecting fool and scare them a little, but thats about it.

Far as the work that was donei owning a shop have went to the dealer for my free tires due to feathering. 2 damn days just for tires and i get a call about needing complete tune up @ 20k. I laughed and went to get my car no problems. Next time you call the dealer and they try and sell you stuff RECORD the convo. Helps out good in COurt.

It would've been fugged up if they forged your signature on the paperwork and showed it to the sheriff.

Back in 95 we bought a Nissan Certified Maxima with 31k on it. I brought it in for some warranty work and the service mgr told me that it was due for the 30k service. He quoted about $800. I borrowed his phone and asked the sales manager to come over. I said "this car was Nissan Certified and it has not had it's 30k service?" I got it free, everything he quoted, plugs, wires, oil change, etc.

Next time I was there he had been fired.

lol very nice dont you love how most of the time they tell half truths and try to get you to pay them more money.
this is why i do all my own work, but figured as long as its covered why not.
....stupid me.

I bought my z used but still under warranty. 3 days later I noticed that the car was not running smooth and took it in. They said that there was a vacuum leak and it would cost $300 to fix. I was pissed. I told them the car was still under warranty and they said it was not because I messed with the engine. I did nothing to the engine but I was 23 then so I guess they just made that assumption. Everything on the car was stock. I got home and looked over the paper work and found out the dealership had a 15 day warranty on top of the factory that will fix any issues. I told dealer about the warenty and they quickly fixed the issue on top of giving me a keyless entry remote which I said I told them I did not get. To think if I did not look at the paper work. Dealers are the worst.

I believe you get a printed work order (that you sign) for whatever you initially requested when you drop off the car, along with the general maintenance check list that Nissan dealers are supposed to do whenever you bring in your car. Once the mechanic makes recommendations for additional repairs/costs, the dealership is supposed to call you and ask for approval for additional work -- which you can verbally agree or disagree with.

Your final paperwork will then indicate that you were advised on what needs to be done, assuming you declined -- or the paperwork will indicate that the additional work was performed per your verbal OK.

I've always wondered what would happen if you were to decline the additional work/parts/costs, etc. over the phone and then find out that the dealership did the work anyway -- when you go pick up your car...

Glad to see it worked out in your favor. I hate it when dealerships try to rip you off and you have to make a big deal about everything to have things rectified.

Wouldn't this constitute as fraud? Agreed though, a civil matter. Law Enforcement folks are usually good at settling disputes. Also, I don't think they can legally hold his vehicle for non-payment for a workorder that is not signed authorizing additional services.

Regardless if the service advisor wrote down 'Verbal OK'. Can't hold someone's property over "he said, she said"
