Default Moronic Intoxicated Driver Rear-ended me...

so only after 3 months of having my car and less than a week of dropping my car (thanks to Kingeddie!!) today at 3:00 a.m I was rear ended by a drunk moronic driver that claims that he "didn't do it" after hitting me =___= My girlfriend quickly got on the phone with the police dispatcher and while reading his license plate to her, he tried fleeing the scene. 10 minutes later, we find out that he was caught 2 exits down the highway and that not only was he drunk, he also had no insurance. Now because of stupid broke *** drivers on the road, I am left with an estimate of 2 weeks without my car, a 500 dollar deductible since the moron didn't have insurance, my 2 back side panels of the car and the trunk hatch has tension bumps on it, the back bumper is F*%k, lights are cracked, and further interior damage needing to be uncovered...My all state authorized service officer so far estimated the repair just by how my car looks at 2,995.35 and he said that the repair will definitely go up to at least a grand or more after being taken apart and seeing how the inside is damage wise...my insurance is surely gonna jump up because of this too >.> *sigh* shitty end to a bad a$$ weekend. Here are some quick pictures of damage that is clearly noticed and more pictures will be uploaded of the damage...

How can YOUR insurance go up if you're in an accident that's not your fault?

idk...thats what i was told today by the person that estimated the total to fix my car. but i will find out all the details tomorrow. =/

Some companies 'punish' you by raising the rates if you've had too many claims in a year. Some states say you're always at fault if you're out driving around. That would be the 50/50 states.

Its good that you are ok!
The pics don't show that much damage???
The thing about insurance,it varies widely from state to state.
You would think that if it was not your fault,the other guy would pay...
Most states have "uninsured drivers" insurance as mandatory.
I am sure Texas has this.
The major bummer is your car will be in the shop.
As this happened at 3:00 am,you are taking a risk with all the idiots on the road at that time.Your insurance company underwriter may have a negative view of you being on the road at that time.
Not fair,what does it matter? Its BS, and thats just the way it is!

You may not be out your $500 deductible forever. My daughter was involved in a rear end collision about 5 years ago. The bill for repairs was almost $11K. The driver at fault had no drivers license and no insurance. Her insurance (actually mine) paid the bill less the deductible. The insurance then filed suit against the uninsured driver. They were able to collect at least the $500 deductible because my daughter got a check from the insurance after about a year. I have no idea if they were able to collect the full amount of the damages but we were glad she got her deductible returned. If I recall, the insurance did not go up.

That's what the uninsured motorist coverage is for. Your rates should not go up if it isn't your fault.

This. Take the lousy **** to the damn cleaners for everything he is worth. DUI and hit and run. he's gonna be fcked for life.

if he owns something you should be able to take it to pay for your damages. don't let people tell you what you have to do.

truth!

Here in VA the ded is $250 for uninsured motorist accidents and my rates HAVE NOT gone up!

Since they caught the guy and you know who it is you can also take him to small claims court to re-coop the ded/plus other costs.

your premium shouldn't go up even if you have the Accident Forgiveness coverage

That sucks, your lucky it didn't hit the trunk too. Time for aftermarket rear though man! Sorry to hear that happened...it sucks!

I know its hard to tell going by pictures, but that really doesn't look like damage upwards of $3k.

Yeh at least me and my girlfriend are okay, just my back and her neck is aching but hey thats an accident for ya. And yes definitely the bummer is that my car will be in the shop for 2 weeks, my sister didn't add uninsured driver onto our policy for some reason when she first signed for it so =/. Hopefully i will get the deductible back but I am definitely going to the lawyer's office tomorrow to see how i can seek payment for all of this. heres more pics with more details. tension bubbles seen on the two panels and a hole through my bumper, the hatch has a tension bubble too but since its dark out i couldn't get a good picture of it, the trunk is pushed in and the hatch needs to literally be pulled up to open. brackets are all broken and under the bumper seems to have been pushed in even worst.

These photos are more revealing than the original. I see a ding in the hatch and the bent sheet metal near the hatch latch. This is certainly $1,000 plus. A reputable body shop will have it looking like new.

It may be different in Texas, but my agent told me they can't write a policy without uninsured driver coverage unless you specifically decline the coverage in writing.

In a perfect world, you'd pay for liability insurance when you buy gas, so nobody would be without coverage. The more you drive and the larger your vehicle, the more you'd pay. That seems reasonable.

The money collected would be doled out to the insurance companies based on the number of drivers they insure with other coverages. That would encourage them to provide reasonable rates and good service.

Rates can go up for any claims, fault or not. There are stats that show people who are no-fault claimants still have higher later accident rates. People with large numbers of claims are also reasons for rate hikes.
