Default People are SUING Nissan

A guy came into my wife's shop the other day who also has a 350Z and mentioned people suing Nissan for only "band-aiding" the tire feathering problem....anyone else hear anything about Nissan getting sued over this?

I'm sure there's individuals who keeps getting feathering problems after multiple attempts to fix it out there suing Nissan. Heard rumors about a class action lawsuit but I don't think it has actually started yet.

Seems like a lemon law outta cover the tire problem if you have to keep going in for it. I know they just extended the coverage (according to autoweek) on 03s, and supposedly will cover some of the cost if you got aftermaket tires and had the problem, but I dunno the details. All I can say is i better not get it again on my 04.

They are not going to win. Sue for what? Sounds like chumps trying to make a dollar the cheap way. I guarantee Nissan has better lawyers than anyone can afford.

I am glad nissan decided to extend the warranty though.

Actually they will win. Nissan is liable for all damages to the vehicle as a result of their negligence. If there were multiple attempts to fix the vehicle unsuccessfully, then the lemon law which applies to the first 18 months after purchase comes into effect.

But usually Lemon Law requires you to go to arbitration with Nissan before going to court, and usually, if you lose that, yoiu don't have much chance. Unless there was a safety risk, I don't seem them winning in court.

You'd be surprised how many companies actually give in during arbitration because they want to:

1. avoid negative publicity that comes from a lawsuit

2. avoid a class action lawsuit altogether.

The tyre feathering issue on our cars is a very good case for a class action. By the way, the condition on our cars could be considered dangerous since if your tyres are wearing out prematurely and you may be unaware of it, this increases your chances of getting into an accident.

If you're such an idiot that you aren't aware of how worn your tires are, you shouldn't be driving a 287hp sports car... And I don't mean that you NeoZ are an idiot (unless you can't tell how worn your tires are)..

I'm in the camp that finds it sick that some of these losers are suing a company for tire wear problems on a sports car PARTICULARLY when said company will buy you new tires if you have this "problem".

Your absolutely right. But haven't you ever noticed that anytime something says: Do Not Attempt and it is some extremely stupid stunt or act, such as ingesting rat poison or such it means someone has done it. Companies usually try to be careful about everything in modern torts litigation, even if it includes trying to predict a customer's behaviour in order to avoid liability. Which means that even if someone is stupid enough to drive with tyres that have been worn out after 9,000 miles Nissan can still be liable because the damage to the tyres occurred prematurely.

Hopefully, Nissan will continue to replace the tyres that are damaged.

the lemon law will last till "Nissbum" fix's the problem. just be sure you register the feathering w/ NNA before the 18 mos. and follow the L.L. rules in your state. "Nissdom" will then give you free tires & alignment for life or till you sell it,or trade it for the new Z. I love this feathering !!!!!!!!!!!!!1

Well I dont ever want to pay for my tires for Nissan's problem. I'm nearing 21K miles (I'm at 18K miles with a roadtrip scheduled for next week) and from then I will start having to pay a portion of the cost.

My $0.02 ...

Why do the tires feather ?

1. Negative camber on the car (designed that way for road track)

2. Alignment may be off from delivery (easy fix)

3. POOR CHOICE OF TIRE !!! Any of you guys go look at the specs of the RE040 ? It has a tread rating of 140 !!! The tires are VERY soft and will show (read exaggerate) every little issue you have on the front end !!! I switched to Pilot Sports with my iForgeds and have 0 problems (Pilot Sports are 220 tread wear).

So why do the G35s have WAY less reports of feathering ... TIRES !!! If you want Nissan to keep putting super soft tires that wear out and handle poorly, keep complaining to them. I have a friend that works for Bridgestone. He said the RE040 was designed to be an inexpensive OEM tire that lasts about 15k miles. Hence, they are CHEAP and very soft. Why is Nissan putting Pilot Sports or S03s on some cars, the tread is not as soft and therefore won't feather under the negative camber. Again, 11000 miles here (some on S-02s and most on Pilot sports) and 0 feathering. I sold the S-02s and they looked brand new. Pilot Sports now have about 4000 on the newest set (first set got attacked by road cr@p) and still no sign of feathering.

Ask around ... who out there with aftermarket wheels and tires have a feathering problem ? Anyone .... Anyone ... ?

I won my buyback hearing. Granted I wanted to stick it to Nissan as much as I can - but that damn "off-set" usage is a &itch. Which is where the mfg will save $$$$.

In the end, it's just not worth it to sue unless you have a real ax to grind. The BBB process was free and I got all my money back (-) the off-set which was factored at $5k. So I'll walk with 8k - which is a hell of a lot better than dealing with the feathering any longer.

I cannot recal the people's names, but I have heard numerous cases of people switching out wheels and tires such as Michelin Pilot Sports and still having feathering. I think it might depend on how bad your feathering case is.

ditto what 350zluvr said. There are many reports of people with non-Bridgestone (and even S03's) who have report recurrence of feathering. The harder compound and higher treadwear rating will only delay the appearance of feathering. Therefore, getting a different tire is not a fix.

No they get the car back and I get the $$$. They had to "buy" the car from the lein holder.
