Default poor little red roadster damage

I told everyone back in April my 07 roadster was rear ended. 2 months have passed. Finally got car back. 11,500 in damages. 8.5 hours used in repairing frame damage. But the bodyshop stated car is as good as new. Right!!!! I took it to another dealer to see if they would take in trade on a new Z. Would not even take in trade as it has some type of frame damage even if it was corrected to factory specs. Contacted a company who handles diimished value. After looking at my final paperwork, stated i could get 10,000 in a claim since there was frame damage and oher damage. Has anybody had any experience in this type of problem?

Its a ***** but you can win it...I did with a Chevy truck. If you havent already done so you can go online and get an estimate of the diminished value. Once you have that its all about filing the claim with the insurance. I had to climb the chain of management to finally get paid. Took about 8 months. From what I remember you have 2 years from the time of the original claim to recover DV...Good luck.

as far as i know, in Cali at least, any frame damage results in a total loss title for the car

Each state has different rules/laws regarding the ability to sue to diminished value.

Did you file a claim against your own insurance? Or did someone else pay? If it was your own insurance, you will probably be stuck with their repair job -- and not be able to collect diminished value. If it was the other side that paid, then you will probably need a lawyer to sue them for diminished value.
