It's too bad you gave a voluntary statement. Your lawyer will have to fight hard to get that thrown out. My lawyer sent me to Psychologists, Chiropractors, and a host of other meetings to attempt to claim I was in shock/in pain and was in no shape to give a statement. My lawyer then started wanting me to lie to the insurance company so I refused to do so and had the charge reduced to following too closely from careless driving.

If a cop asks you what happened just tell them that you are sorry and don't want to be a dick but you will not give a statement. The cop will insist that you have to and then give the statement. That way they can not use the statement in court.

 

Sorry for double post but stay away from Toronto Traffic Tickets. They are crooked as all hell.

 

any updates on this? i'd be interested to know the outcome.
careless driving is 6 demerits i think? But its a ticket that is handed out to most people at fault in an accident. I've also heard the charge always gets reduced.
