Default Differentials & Safety

So the IIHS rates the 350z as a dangerous car.

I have a 2007 Touring or Grand Touring/convertible and believe it has VLSD and had a spin out on wet pavement. I believe the design and type of car prone to fishtailing, and that VLSD leads to sudden changes in wheel speed and causes a dangerous situation, especially when exiting a curve where the inner wheel is forced to run at the same speed as the outer one. Am I right? I believe an open/split differential would be safer. Has anyone else done this?

What I can tell you is no car with VDC is losing control with proper tires. I drove mine in the winter with performance winter tires and I could quite literally drive as hard as I wanted on the highway (80+mph) and never ever felt unsafe.
