In my opinion your car would look a lot better without the spoiler. But if you didn't give them instructions or even TELL them "look, it's supposed to sit like this on the trunk", they shouldn't be obligated to change it for free. If you go into the barber shop, do you tell them, "just cut my hair", or do you tell them exactly how you want it cut? If they fix it, even for a small fee and make it look good, be a good customer and bring them business (after all, it wasn't their fault). If they don't, then tough poop dude. But at least you know you won't make the same (costly) mistake again.

something else i just noticed while looking at other nismo spoilers is that yours is kinda weird. the tips are supposed to line up with your taillight tips and almost create a symmetrical image. your spoiler is lined up correctly in that aspect but it's too far up forward. if you line it up with the back, it'll come up short and still look funny. this is how a normal nismo looks:
even when aligned with the rear, the tips reach the tips of the taillight. i think it's more of a spoiler problem than a placement problem.

Take some pics to the body shop and show them how it's supposed to look. The body shop should be able to fix that no problem. They probably will just slab on some bondo in the holes and move the sucker back. I doubt the mount screws are on the edges so the body shop should have room to work it back that little bit. I wouldn't worry about it. Looks good otherwise.

just the bodyshop didnt place the spoiler in the right place
though i dunno how spoilerdepot's spoiler quality is
