Looks good to me! I don't see the real problem. How can this cause any real problems? If you can live with it so can I. Spend that money on side skirts or a chin spoiler. If you can get them to correct it, then power to the people.

No... I got it fixed. It was 150 to move it back, the hole were already covered so no painting was required. the body shop sealed the holes and its great now
i took it to a diff bodyshop for this, mendlesons autobody, in san ramon, my dad knows the owner
ill take pics later but my sis' car is in fron tof my garage and they are eating dinner

yeah, i think its better too. im really happy it only came down to $150. and brooksie, DEFINATELY make sure you point it out. and thanks manofsteele, i just need some rims, and then to finish my lip kit

If you didn't specify where exactly you wanted it then you will have a hard time getting it to be fixed with no charge. If you had instructions and gave it to them --verbally or written then you are in the right. If you just said mount this, then you may be responsibel for them to fix it--although common sense would say the spoiler should be aligned with the edge of the hatch.
