I read the thread and find that the first five replies were sarcastic in nature and one of them was from a moderator(350zspeedracer).
in fact the the personal assaults started with 350trackz stating...
Daking ... you have spent so much money on the cr@p for your car, shut up about $73 .. as a matter of fact, shut up about EVERYTHING. You have GOT to be the most negative person I have EVER run across. You state "Borla Blows" ... why, because you mess up and they make a profit on you. World ain't free pal.

If I were Borla, I would have charged you more for trying to go around me !!! You complain about everything and I'm sure you were far from polite with the guy.

Damn, I've been wanting to say that for some time ...

then it proceeded to a personal attack on his wife by raceboy who stated:

daking350, your wife threw away the part!! It's her fault so I really can't see what you are whining about (whining again after you stated you were done here rather dramatically). The thread should have been titled; "My wife blows!!!"but that might be taken in the wrong way!

That appears to violate the rules of the forum I would say.

And then I noticed a moderator, Rouxeny jumped in and fueled the fire a bit by once again insulting the guys character instead of stopping the thread before it got to the point it did

It seems kind of rude for you to whine about it also. I won't go into why I think that, many people have posted very good reasons already. You actually seem honestly surprised that people haven't rallied around your cause and started sending hate mail to Borla. I'm sure right now that Borla is very glad they didn't sponsor you. Good luck getting anybody else to.

Then I also notice Rouxeny said:

Now where's that "Internet Bully" pic I've been saving? It'd be perfect here

This is how a moderator handles things?
Then another personal assault from 350trackz

__If I ever met you, trust me ... I'd have plenty to say.

Borla blows ONLY because you didn't get what you want ... here is your pasifier little one ...

That actually sounds like a thinly veiled threat to me,kind of like the ones he was banned for.

Then Hraesvelg insulted him further.

Maybe you need to cut down on "the juice"? I hear it makes your ***** smaller

Wow.He dissed the guy's ***** and accused him of JUICING?
Then yet another personal assault from DCZONER
daking's a cop... It all comes together now... lol... gross inability to deal with personal problems... proactive rage... defensive mechanism that almost immediately draws to violence... inability to manage normal social interactions... authority issues... power complex...

Sure sounds like everyone who participated in that thread is guilty of the same infractions he was banned for. Including at least two moderators.

You are entirely in your right to disagree. DcZoner who I know personally and consider a friend also disagrees with me. I'm not always right and I may be wrong here. Fact of the matter is, the forum lost a good resource. Daking did infact contribute very significantly to the forum by reporting on his mods. However, I'm not taking this personally. Daking never attacked me personally so I have nothing to take personal. I posted and continue to do so because there came a point when Daking's responses became unacceptable behavior.

It's one thing to make comments about sucking, kissing, leaking, blowing, biting, this that or the other. It's entirely different when the line is crossed from insult to threat. Pretend for a moment that you're the one being addressed:

Daking: hey YOU, I can not wait to meet you on the 24th of april so I can place a face to the name...

YOU: If I ever met you, trust me ... I'd have plenty to say.
Daking: No...You would not...Trust me...

If you have never met this guy, can you honestly say you want to?

It really is a shame Daking got himself banned. The forum lost a valuable resource. But, that resource was outweighed by his inability to control his anger towards forum members and a moderator.

Oh. And one more thing.I also couldnt help but notice that HFM,you know the guy that quoted the forum rules on THIS thread pointing out the THINLY VEILED threats part, stated this in the last post.
Posted by HFM on 3/29/04 at 04:14 am

You are one angry sumbitch. You don't belong on this forum. You don't belong at any meet. And, I don't think you belong on the force.

You're one scary mother f'cker that will make people not want to show up at friendly meets and don't want to have anything to do with your horrible being. I don't know what happened to you but you're the type of cop that needs internal affairs on your back because the kinds of threats you like to make when you don't think you're accountable are the kinds of threats some punkass would make when they're about to cap someone for just being who they are. I've got nothing more to say to you other than grow up boy and I can't wait to see your *** banned. And, if you want to fly out here to CA, I'll make sure to have a shitload of cop buds are out here to greet your sorryass.

That sure sounds like FLAMING and ABUSIVE launguage towards another member,in fact his very last sentence is not a THINLY VEILED threat, but an OUTRIGHT threat!!!
Need I say more.

Thanks EC. The defense rests.

Here's a thought. Does anybody seriously think that Julian called up Borla and in his most polite voice, asked them if they could help him out as he had a problem with having lost his gaskets? Then, out of the blue, Borla started giving him 'tude. He continued to be nice and yet somehow the Borla rep was just horribly rude and unhelpful?

Somehow I doubt it.

I've never met Julian, from what I hear, he's a pretty good guy outside of this site. I'm sure he is, but he's had a history of pretty bad behaviour here. I didn't ban him, it's obvious that the two of us haven't always gotten along, and I didn't want my personal feelings toward him to be the reason for him not being on the site. I've always left the giving of strikes and this banning to the other mods who are more objective. Not to say that I don't agree, or that I haven't made my opinion made, but I didn't want the conflict of interest. Yes, I felt he was threatening me. No, I did not request anybody to do anything about it.

Was he provoked in that thread? Well, looking back, he probably was. Having said that, getting the guy mad is about as easy as falling off a cliff. Even daking's biggest supporters would agree that he's got a tendency to become rapidly emotional. Think about how if you were in his position, you would have probably handled everything in a different way.

If he is really such a nice guy in the real world, why couldn't he see that that personna would be much better received on the Internet than his hyper-aggressive "Bring it on" one?

Also note that the website has something around 5000-7000 members, I don't remember the most recent count. Of these, we've banned maybe 20-30 (if that many) for the gross violations, obvious trolling, pornography, racist posts, excessive obscenity, etc. We have banned less than 10 long-term members for situations such as this. In fact, some of those 10 are members again.

I'm sure that he'll find somewhere else to post, it's a big wide world out there.

Come on, this is the internet.. do really think everyone on here acts the exact same way they do in real life?
Disagreement is not a personal attack mode. The initial barrage of criticizm was fairly straightforward: your wife threw it up so you have no claim. That's not a personal attack, that is a contrary position, which is necessary for a logical debate.

After Daking350's initial post, several people disagreed with him but I see no evidence of a personal attack. The best candidate is someone telling him to "quit bitching." Following the disagreement Daking returned with: "First of all for all you people who feel the need to flame me for sharing an experience with you then proceed to turn up the IGNORANCE and flame me for posting an experience with a manufacturer..."

He HADN'T been flamed. He just called disagreement flaming. Then he started "counterflaming."

10.) HARASSMENT/FLAMING
Any harassment of other members will not be tolerated. Name calling, picking fights, etc. Do not make posts that incite arguments, or any post that turns to arguments and flame wars, etc. Posts of this nature will not be tolerated and can result in the immediate closing or deletion or editing of the post and the banishment of the posting members account. Any insults or harassments towards staff members will result in instant banishment.

He was clearly threatening 350trackz and Rouxeny. Above and beyond being argumentative, inciting flames, he was subject to immediate banishment for the above and in particular, for insult and harrassment of a staff member. His comments about wanting to meet Rouxeny were threatening, intimidating and as I said elsewhere, scary.

21.) STRIKES
Strikes or warnings are issued for misbehaviors or for breaking rules. These strikes carry on to all usernames of the same person. Same goes for banishment; when a person is banned, all of their existing usernames are banned as well. There are ways to track usernames of the same person.

MY350Z.COM reserves the right to change these rules at any time and the staff's word is final.

If you receive an e-mail/private message from a "Moderator" addressing behavioral issues please don't take it as a personal attack. The Staff of MY350Z.COM are here to assist with making this site run smoothly and this means from time to time Staff may offer corrective suggestions and/or advice.

Rules as stated above apply to ALL forums within the MY350Z.COM Forums community however, certain forums contain rules in ADDITION to those set out above. You must also adhere to the individual rules (if they exist) when you post in that particular forum. They will be found directly below this announcement...

Please feel free to report any posts that you feel are in violation of the terms set forth. Use the "Report this Post to a Moderator" method or a moderator you see online. Either way is acceptable and appreciated.

In short, any unsuitable attitudes here lack in common sense will be violation of the rules. Any violations could end up banning you from this board and also from "the system"!!

For the reasons posted above, he was subject to immediate banishment and not just another strike. Daking's posts were threatening and dangerous to other forum members. Banning was the appropriate response.

EricCartman = Daking350.

As you said on the other site, you've tried to come back. The next time, please don't post that you got banned, and try to modify your posts so that it's not in the same style, ie. various words capitalized and the smilies at the end of sentences. Oh, and the quoting is the same also.

Sorry, banned again.

I agree they were sarcastic but they were not personal attacks.

Is sarcasm so inappropriate?

I'm sarcastic 9/10 of the time, so if i need to cut that out I need to know.

Daking made a good point about my post on the other thread. It wasn't suger coated by any means. My response became cold, hard and I will admit, nasty. When I feel someone is abusing someone else, I don't mince words.

Like I said, Daking is scary. The first thing I did after I posted was I asked a forum member whether he's seen my plates on any thread. Cops can track down names, addresses, an enormous amount of information just from plates. I was making it clear that I'm not defenseless by pointing out I have cop friends.

If that is an issue or if a moderator believes I acted inappropriately, I will accept a strike without complaint.

Illogical.

While it is a goal that the rules be applied uniformly, that an enforcer of rules has broken the rules does not in any way excuse a subject from punishment. If you disagree, next time you get pulled over tell the cop "but you were speeding too" and see how far that gets you.

Pete (thinks that should be pretty darn obvious)

Yes they were sarcastic remarks, but I also don't think his sudden need to vent on this trolling issue stemmed from this post alone. I've seen plenty other post where people have attacked his comments and made it personal. Even someone else on this thread said his profession of being a cop came up to play in another thread as well. There's nothing wrong with being sarcastic, but in all honestly I'd be sick of it too if everytime i posted something that people didn't agree with would jump at the opportunity to flame me.

All I said is that I had to bite my tongue, Daking. Read into that what you want--you seem to think I have a personal mission to "get you" or something.

Do you want me to properly explain my post to you? Here it is, so get ready. I feel that your entire approach to that thread was completely misguided and immature. If you had merely wanted to share your experience about the expensive gaskets, you shouldn't have titled the thread "Borla blows" and gone off on your rant. Plain and simple.

So if he titled it "this blows" , you would have read it differently and responded differently ? Maybe, but we all read what we want into these posts. I doubt you can tell what he was really thinking from the title and the initial post. Keeping the sarcastic remark to yourself would have been better.

Petey, your vision is clouded! I sure bet I get out of that ticket if the cop provokes me into breaking the law!

I was simply restating that a majority of readers feel that he was being jumped on (in this thread and others) and was provoked by several members including 3 mods. His responses were harsh (like i said before) and in no way appropriate but so were many of the others. There were personal attacks going in several directions. None were right but only one was banned. Mods needs to act more appropriately (close the thread instead of joining in the attack) and come under scrutiny when THEY act inappropriately. They certainbly shouldnt be provoking hostility which is exactly what occurred.

So yes I think it is fair to unban the guy (particularly if it was one of the mods on the thread that banned him).

Actually, none of the mods on the thread banned him, although I think all of the three agree.
