If Endangered Performance has money in their Paypal account, then Paypal can probably reverse it. If they don't, which is likely especially if it's really a scam, then that will make things difficult.

Notify Paypal of the fraud by certified mail (probably need to send airmail at this point) even though you already called. A phone call is not sufficient to prove you contacted them.

Try your best to get written confirmation from Paypal that this is a case of fraud and that you are not responsible, less any deductible you might be contracturally obligated to. If you do get the letter, keep it forever in a safe(ty deposit box).

I'm sure they're going to do an "investigation" that will drag on for weeks. There may even be stupid crap like them withdrawing from your linked savings account once they detect your CC charge back even though they're in the middle of the investigation.

Finally, you might consider getting a lawyer to help you out if things start to get messy.

Disclaimer:
I'm not a lawyer, and my advice is provided "as is." I'm just passing along what I remember from Clark Howard.

Best of luck with this,
Jeff

Yup. WSB 750 AM is his home station and is syndicated elsewhere. WSB-TV is Channel 2. Both WSB-TV and WSB-AM are owned by *** Communications, I believe. He occasionally does the special reports on the TV news about consumer affairs.

THANKS FOR ALL THE SUPPORT.

barthelb- you have a PM

RAR- Thanks, but I don't have the complete address. All ebay will give me is that it is located in Fayetteville, NC
The owner is Corey J. Benoit you can reach him at 910-273-8650 and see if he will answer. Thanks for the thought of hired muscle

All my claims to ebay and paypal were through their online forms and I received a confirmation number via email. My credit card company gave me a credit and it is already on my balance. I hope that is good!

Paypal and tradesquare e-mailed me to tell me that they could not reach this guy and they will continue to try. Paypal also e-mailed me to tell me that they received the chargeback from my credit card for the fraudulent purchase. I hope this is it and once again THANKS FOR THE SUPPORT AND INFO----- James Schambers

Here is the secret to protecting yourself with Paypal:

When I signed up for Paypal, I created a new checking account with only the minimum amount to avoid a monthly fee, like $150 or something. Once things were verified, I put a block on the checking account, so Paypal cannot touch a penny of my money even if they tried. I do ALL transactions using a credit card, so if I ever do a chargeback Paypal will attempt to take it back out of my checking account, which they can legally do as it's in the agreement when you sign up. They can't though if the account is blocked
