Default possible scammed twin turbos

I need some advice on what to do. I ordered a greddy twin turbo kit from ebay on Jan 28. I ordered it from an ebay store called Endangered Performance in Fayetteville NC, which sells mostly rsx parts. I paid with a credit card through paypal. I emailed the man several times for a receipt, proof of purchase, or an estimation on arrival. He answered and stated around Feb 28 I will get a confirmation number and delivery date, because he ordered it and it takes greddy 3 weeks to produce the turbos. Well, he stoped answering his e-mails on Feb 13 and has not answered any of my calls. I made a claim through paypal and one through trade square. I am not sure on what they will do, but all I want is my money or the product. Any advice?
Thanks James

You have 45 days to put in a compaint on paypal, send him an email that if you do not receive it by day 43 that you will request a credit through paypal or he can issue a refund.

Contact E-Bay, Paypal, and you CC company.

Got an E-Bay link or this guys www or e-mail address?

This is one reason why I don't buy anything expensive via paypal or e-bay!

If you used your CREDIT CARD, you can in form them of the fruad also.

I once used paypal through my bank account and recieved busted up merchendise. UPS, eBay, nor the seller took any responceabilty.

But if I only used my credit card, they love me, I will be there with the till the end of time paying there interest. So of coarse they want me happy.

I put in a complaint to paypal yesterday. Will paypal get my money back to me. What exactly will paypal do?

You can only take it to court in the county in which he lives. I live about 23 hrs away but I will fly there to make a point.

Thanks is there anything else?

The best approach on this matter will be to deal with your credit card company. There are laws that cover these type of situations and the CC company has plenty of people to go after this guy.
Now, before some deadline passes because I'm sure there is one, tell the CC company to REVERSE THE CHARGES. Basically, they credit your card and pull the money they sent him.

I think with paypal you are only covered up to 500 bucks.

Default This may help!

I got scammed trying to buy something out of the US to send here to Australia. After the emails stopped coming from the seller, I took the following steps:

1. Checked his email messages for an IP address. His IP address mapped (using DNS and whois tools) to a US stockbroker company.

2. At the same time as 1. I called a private detective in the US, and provided the sellers details from ebay and paypal. Its not so easy to setup a fraudulent paypal account because of the credit card verification.

3. I called the company i found in point 1 and asked the admin assistant for the guy. No luck, she had no number for him.

4. The details came back from the Private detective confirming home address, phone number, social security, employment history etc. I found he did in fact work for that stockbrokerage company.

5. I called company again, and confirmed he worked there.

6. I sent a final warning email to the seller. "Your last chance to do the right thing".

7. I send an email to all the senior management at the stockbroker company (about 20 in all) with title "XYZ stock company employees conducting fraudulent auctions on ebay".

8. The next business day I received a response from the seller asking for my address, and an email from his employer saying they had spoken to the guy. I also received an email from the seller after I received the goods, asking me to contact his employer to say he had delivered on his promise. I ignored that.

I'd try the PI thing. They are pretty good. Took about 3 days to get all the details. Also look in the email message headers you were sent. You never know, they may have a static IP or be contacting you from a registered address which you can track.

Let me know if I can help. Scammers must pay!

quickest way to get your money back is to file fraud claim with your cc company, but do it quickly cuz they have time limitations.

Man, sry to hear about ur loss. But lemme give u some of the bad news first.

Paypal prolly won't do jack crap w/o a ton of complaints regarding this seller.

I know this because there was a scammer that went around forum boards selling non-existent items and ran away w/ many ppl's money. Paypal won't pay attention and prolly don't have the man power to pay attention to every complaint they get, it's just not possible.

What they'll tell u is that they will investigate etc etc. I myself lost 280 dollars to this scammer, and one magical day Paypal sent about 180 dollars back to me, but not in full. Some ppl I know got their full amount back, but I'm guessing because it was a small amount compared to mine.

Keep in mind this scammer had TONS of ppl scammed and was infamous in the most of popular forums. So PayPal received tons of complaints from a TON of forum members who got scammed. Not just that, the scammer was also reported to his local police and business commission.

The boards no doubt has his IP, but ISP companies cannot disclose any individual's personal information even you have his IP or have traced it to where it is coming from and who is providing the service. I know this as well because ppl have attempted that as well. It's a matter of privacy laws blah blah. That might sound ridiculous because some will think it's protecting the criminal who scammed ppl, but that's the way the law works unfortunately.

But because you ordered from eBay, they MAY be able to help you because they're usually pretty strict about that. They prolly have ur seller's info on file along w/ credit information. I would try eBay first.

If the guy already cashed out on ur credit card and u couldn't stop the payment from going thru, then I hope ur have credit fraud protection, otherwise u're kinda screwed cuz the the cc company prolly won't take ur case seriously

Going back to my case regarding being scammed b4, I even contacted a consumer reports specialist b4, but they just tell u to contact agencies blah, so not much help unless it's a huge country wide scam or of that magnitude.

It seems as though ur options are as follows:

eBay, PayPal, your bank, your credit card provider, business commision, and the scammer's local police. Go fill out as many fraud forms as possible. And finding ppl who also have been scammed by tat person is indispensible. That will help ur case greatly!

Do a bit of digging on the web and gather as much info as u can. If u are unable to find the seller and get ur money back, u can be certain u'll have a hard time getting any of it back, if any at all cuz no company will be willing to dish out 2k+ of money

As for going to court, well, it's very time consuming and a relatively very last resort. Lawyer fees aren't cheap ><

Sry 'bout the long post, I hope I have provided some valuable info to ur case. I hope they catch that focker who did this to u or anyone else.

-------------------------------

Private invest. might prove very helpful if his company is still active on eBay. But if he's moved outta the country or nowhere to be found, then u're kinda in the short side of things. U can always go to his home and beat the living $hit outta him/her, lol.

eBay is typically a very responsible company, they'll do the right thing for u.

Eugh.... I stopped buying much stuff off Ebay. I only buy little items that aren't available here, or I buy bulk stuff like LEDs.

My bud bought a USED turbo kit for his Prelude SH. The kit was missing bolts, screws, gaskets, and some other misc. items. Once installed, it was a pain to tune it because the fuel controller wasn't responding to changes to the car kept running rich. He wasn't getting much boost either. Well, my buddy got lazy and continued to run his car like that for about a couple months until it went POW! while trying to race someone. ETA 1/4mile? About 17 seconds. :-P

Always use a CC. Try to use AMEX whenever possible - they are very good at covering your azz.

I was listening to Clark Howard (consumer rights radio talk show host in ATL) and he said that Paypal can negate protections from your credit card. It's considered a 3rd party payment or something like that. Basically, you're going to have to work with Paypal rather than rely on your credit card's protection.

I think the guy that called Clark about this problem actually got their CC to do a charge back against Paypal (or some other similar service) and they threatened to sue claiming a contractual obligation, regardless of the fact that the buyer got scammed.

Unfortunately, this is not good news for you. I'd say move fast and try to get out of the deal! Next time, buy directly with a credit card. Use your card with the best purchase protection. For instance, my AMEX card doubles manufacturer warranties as well as the purchase protection (within 60 days).

Well, I called my credit card company (VISA) and they told me to call back tomarrow morning. The man did state if I follow e-bay's and paypal's policies on fraud claims and then contact them my chances of getting a credit on the card is good. He also stated there is no time limit for me to report it to the card. Thanks

Made contact with the credit card company today and they issued me a credit for the amount of the purchase. How long should I wait before buying the twins from a real distributor? Do you think paypal will dispute the credit as jeffw stated? Thanks

They probably will and if you set up your personal bank account with the paypal as a payment option they might try to put it through there.

Check what you agreed to when you clicked to join paypal.
