Default Tial Wastegate Problems

Hey guys, i have some problem. i purchased a tial 38mm wastegate. And sad to say it is stuck open
no matter what i do even if i unplug all the vaccum lines it still is stuck open..
do i have to remove it and get this replace or any suggestions?

install the valve seat and it wont leak anymore.
