the intake that is straight tube without disconnections is an older model of the nismo intake. I beleive it was a v1 or v2. The latest one (v3 i believe) looks just like the one you pictured. I was told by jason that the single tube (older model ones) had some trouble which is why nismo decided to switch back to the seperate tubing. In my opinion, the single tubing looks a lot better...

I have been told I have one of the rare Version 2 Nismo intakes. Apparantly the Version 1 and Version 3 both have 3 pipes whereas mine only has 2 pipes. I believe there were some small changes in design between the Version 1 and Version 3 as well. I ordered mine from Lee Auto Mall online. They might still have some Version 2s if anyone is interested. It comes with the bypass and a coupler for the lower pipe connection. I chose to use the coupler and have the bypass sitting on my counter top.

Nope, it has run like stock since the day I put it on with no issues. Other than the increase in power and lovely intake sound.

I will go by what K&N says. Don't worry about it that much. The filter is still proteced all the way around by covers and the dirt just accumulates in the crevices and doesn't really effect air flow at all.
