Looks to me like the pipe that is suppose to be in the area in front of the tire has been cut smaller.. If i was you... I would remove that little piece of pipe and use the intake as a short version..

I assume you bought this used?

Aceman, I think your are mistaking the air bypass valve for the bottom of a cone filter.

There is another section of pipe on the other side of the bypass valve that goes into the wheel well which the filter attaches to.

My suggestion is to loosen all of the clamps and connectors on the intake system, and unbolt the bracket. Jack up the left front corner of the car (driver's side), remove the wheel and plastic fender liner, and adjust the fitment of the system. If the filter is pressing slightly against the fender liner, it's not a big deal. The bigger issue, is to make sure the intake pipe going into the fender well is not making contact with the chassis or headlight bracket/support. It's a tight fit. Just make sure you have decent room in there.

In addition, remember that as the engine revs, it will move on its mounts. Anything attached to the engine (your intake for example) will move as well. So take that into consideration when adjusting things.

A long tube, cold air intake on the VQ makes a great noise at 5500rpm under full throttle. However, the gains may not be much greater than a K&N panel filter in the stock airbox (either one will give you roughly 3-5 hp, depending on ambient temp).

If you cannot get your intake to fit to your liking, I would suggest going down to Autozone/Checker/Pepboys and picking up a K&N panel filter for $50 (you can get them on ebay too). You will lose the noise of the cold air intake, but your drivability will improve (especially at lower rpms). And everything will fit like OEM.
