If it is a cat back, then it doesn't need CARB. If it replaces/eliminates the cats, then there is no way its CARB approved.

I thought that if it is cat-back, then it shouldn't matter. Anyone know for sure?

A system that is after the cat has nothing to do with CARB (California Air Resources Board). Only parts that could possibly effect the emmissions of a car can apply for a EO# (executive order) exeption. Manufactuerers can pay for/submit a product for testing by CARB and if it passes CARB then the user can get the car smogged with it on. Since cat back exhausts are after the cat they don't effect the emissions.
In California the law that has to do with exhausts is about sound pressure level. If the exhaust is over 95db at a certain rpm/level in some SAE test then it can be deemed illegal. There are ref stations where you can get them certified now I believe to prove that your car is legal and they will drop the ticket. Most manufacturers (like HKS, Greddy ect) try to make thier systems to this spec otherwise they list them as "racing". Hope this hepls.
