Default control lever housing problem!! rear trans case f'd??

long story here...and i need help please...

1. had an '03 track ed. z, the trans was replaced on that car and it ran like a beauty...

2. i crashed that z, took the engine, trans (CD009), spec stage 2 clutch, JWT flywheel, rims, dif, brembos...anything good really off before the insurance company took it back...

3. got another '03 track edition z with 36,xxx miles on it and it was running good for a bit...then started having minor trans (CD003) issues 3rd gear started to grind when i shifted up into it or down into it...every other gear was fine...

4. i decided to swap the clutch, flywheel, and trans and live happily ever after...or so i thought...

i put it all back together with the replacement trans...and hey, the bracket (control lever housing) that goes on the top of the trans and holds the shifter in place just doesn't seem to fit right...we put a couple spacers in and it seemed to be ok...but the shifter itself seemed to be like pushed back or angled back some...seemed weird but worked ok...

later that day, the shift linkage ripped apart, we looked at this bracket and came to the conclusion that there is no way that this bracket SHOULD fit...the distance from the upper bolt hole to the side hole on the rear trans case is 4 7/8 inches on the trans that is currently in my car (the 2007 replacement CD009). On the old trans (2003, CD003) and the control lever housing bracket the distance is aprox. 5 1/4 inches. Nissan insists that the trans i currently have in the car (CD009) will work with any bracket because there was only one bracket ever used....SOOOO that means the rear trans case on the CD009 is incorrect, modified, warped, ect. or the nissan tech I talked is retarded and there is a difference in bracket between the earlier and later transmissions. So should I...

A. swap the trans and deal with 3rd grind

B. go to nissan with my car and say "get the right bracket on my car"

C. try changing the rear trans case to fit the bracket i have

D. light my car on fire and get a honda

any and all feedback is appreciated in advance!!!

can't access that page...i just registered but i gotta wait for it to be activated....the bracket i'm talking about is the "Control Lever Housing"...seems like the rear trans case is different because the holes don't line up...but the control lever housing fits perfectly on my last trans...
