N-electric, the immunity of small children has no bearing on your claim. Insurance policies cover the vehicle, not any particular driver. If a dog inside the car had caused this, you would be compensated. The lady who was loading the trunk, (and who also failed to secure the car and the kid inside it) had care and control of the car. It was her mistake that caused this; these things are covered by standard policies. I can’t imagine how an insurance rep could be so clueless as to not recognize this.
If the insurance policy was written for the Jag in Ohio, than you could make a claim for DV under Ohio statutes. It’s above my pay grade to know what your chances are in Ohio, but any place has to be better than Pennsylvania.
By the way, was the car engine running and was this an automatic or a manual trans. Presumably the parking brake was not engaged.

Thanks Jennifer. Are you by any chance a lawyer or insurance adjuster? You seem to know a lot on the subject.
I thought that insurance covered the car, not the person, but I don't know nearly enough about it to try to correct an insurance adjust on the spot. So this means that Allstate will not have any ground to deny this, good.

Finding a good auto body shop is also a pain. Every shop I come across just looks so small and shady.

So I dropped off my car at RAC Appearance (http://racappearance.com/). They look like a good shop, and were recommended by a local dealership that sells a lot of classic cars (http://www.leopardiautosales.com/). They just finished a Nismo 305Z also.
He said that it will probably be about $3800. It will involve completely replacing the rear quarter panel and rear bumper cover along with popping out and repairing the driver's door. He also said that the small driver's side corner window will have to be removed to replace the quarter panel, but there will be a lifetime warranty against the window leaking and the paint fading.
In the mean time my insurance company still hasn't received the police report even though the requested it Monday and left another voice mail at the PD on Wednesday morning. They said that it's normal for it to take a week or more to receive the police report.

Ok, so my car is FINALLY done - mostly. At this point I feel like the body shop has had and driven my car more than I have. Anyway, here are the results:



For the most part I'm pleased with the result.
But I still have one REALLY BIG problem. The vehicle ID sicker, the one with the date of manufacture, color codes, VIN, etc. was on the panel that had to be replaced, so obviously the new panel doesn't have this sticker. I had the old one cut out from the old panel and I currently have that. The problem is that Nissan has told me that never, under any circumstances, do they ever reprint that sticker for anyone, ever! So it sounds like I'm f*cked. The guy did say that there are some people and websites that will make "reproduction" stickers for just this purpose, but unfortunately they are not authentic. Do any of you have any ideas or suggestions as to what I should do about this vehicle ID sticker?
The old panel also had the tire information sticker, but Nissan did allow me to order another one of those (for $13.89) because it didn't have the VIN on it.

I'd just get a fake one printed to put in the door and keep the original in the glovebox. I'd think that as long as everything matches to the VIN on the car, you shouldn't have a problem.
Do you have any idea which company online prints the most realistic looking stickers? There seem to be a few different ones out there. They also seem to charge about $125 for the sticker, so I'll have to contact the insurance company again to get them to pay for it.
Looks like they done a good job..I know you mentioned earlier in the thread that you liked those stockers, but new wheels would set that car off..not knocking stock, just promoting setting your car off..
