I don't think getting in a wreck "with" a drunk and "from" a drunk are really comparable...

How do you figure??? The pic doesn't really show views from inside the wheel well or under the body.

He was a passenger with a drunk driver showing off and hit a car; you were hit by a drunk driver. Seemed pretty different to me.

Totalled, imo, especially with the airbags deployed.

Did that drunk driver put those wheels on your car also? What a jerk.

UPDATE: finally in the shop. its got $8,500 worth of damage not including a new rim and any suspension damage that might have occurred and its still not totaled. WTF??! anything i can do about this? And what should the depreciated value be?

Well at least the car is in the shop, I still don't see any suspension damage yet. OP you can find a local private adjuster in your area to help you out with the diminished value, NOT ALL STATES HAVE DIMINISHED VALUE LAWS ON THE BOOKS.

Georgia has a diminished value law. Im still going to try to talk to insurance to consider the lost inherent value in the calculation as to whether the car is to be totalled or not. They are being real sketchy though.
