Speeding ticket "Unposted speed" ???

Default Speeding ticket "Unposted speed" ???

Hey guys. Last auguest I received a speeding ticket on Grand Central Parkway in Queens, NY.

Been driving 5 years, and this is my first speeding ticket ever and its for going 48mph on the highway....apparently the speed limit was 30.

On the ticket under description, it says "Unposted speed"

What does unposted speed mean? That there are no speed limit signs in that area?

Anyway, I decided to plead not guilty and just show up to court. I feel it is an unfair ticket because I thought that going 48mph on a parkway was very "legal". How was I supposed to know that 30mph is the speed limit??

*oh yeah, I mailed my ticket in and I forgot to make a copy of it. Is this going to be detrimental to my case?*

Unposted speedlimit in NY is 30 MPH. It differs from state to state.

Get a good lawyer. Just curious which part of the Grand Central near Laguardia.

yeah he said the speed limit was 30. I had no idea it was so low. I was on the highway

Hm I forgot which part of Grand central i was on, but I dont think I was near Laguardia. I had just came from Flushing and was on Grand Central for not too long before the cop stopped me. I was trying to get back onto the BQE

Anyway, hopefully the cop won't show up on the court date.

EDIT: oh yeah, I also don't have a copy of my ticket because I mailed it back, and forgot to make a copy.

Is this going to be a problem when I show up in court?

EDIT 2: sorry last thing. I've never tried fighting a speeding ticket (this is my first ticket), so can anybody shed some insight on how I should tackle this? What I should expect?

It had to be just past the airport getting onto the BQE because of the construction that's why the speed limit was I believe 35mph I pass by it almost every day. I were you get a good traffic lawyer. Most likely the judge will side with the cop. There will be point involved. It must be the end or beginning of the month that why he gave you for 48. Most ppl drive above that and don't get pull over. I personally do 55 to 60 knock on wood. Good luck. Btw how did you plead by mail. I thought if u plead not guilty there is a court day to appear instead of mailing it in.

theres a box where you check, if you want to plead not guilty. and you mail it in.

they processed it and gave me a court date.

and nope, definitely no construction. It was a very large and empty road with no construction.

I think THeFarmer is right though. There was no posted speed limit signs. so in cases like that, it would be 30mph. I didnt know that though, until after this incident.

anyway, i've postponed my court date.

If not posted then the speed limit on the Grand Central should be 50mph unless construction zone which start from the Mobil gas station to the BQE ramp.

i got this back in August of last year.

I dont think there was any construction during that time

The same thing happened to me yesterday. I was on the service road for the Grand Central Parkway, going with the flow of traffic and moving over to the left lane preparing to enter the GCP, just before LaGuardia Airport, eastbound on Astoria Blvd South. The cops were parked on a side street near the cemetery, and pulled me over, said I was doing 45 in a 30 mile per hour zone. Gave me a ticket for $203.

Also, there was no construction at this time, there were a number of cars on the road, going at approximately same speed as me or faster. How do they know that it was me they clocked? Or is it just the luck of the draw, and they ticket who they can?

Any thoughts, suggestions, ideas...please??? Thx.

Suggestion? Don't go 45 in a 30 zone. It's not a difficult concept.

Don't feel bad that same cop always hide right at the entrance to ST. Michael cemetery. Did you get clock around 2:30pm. I was doing 30 but feel like I was moving really slow cuz other driver beside me were doing way above that. I have been down that blvd a lot there always someone get clock by him. Not just the service road you were on also on GCP coming from the Bridge.

Syner: brilliant concept! wonder why I never thought of that in my 25+ years of driving with no blemishes and no speeding tickets on my driving record. also, guess I should have looked at the posted speed limit...oh right there is none. thx for the genius insight, we should all be as clairvoyant, wise and perfect as you, especially while being pulled over by a cop for the first time in our lives as we’re entering onto one the busiest highways in the country, heading to see our brother in the hospital.
