So recently I got in an accident, some lady didn't see my car as she was pulling out of an apartment complex while I was about to pull in and bam hits my car. ***'s up my driverside headlight, bumper, and little damage done to my hood. So she told me to go out and get an estimate to get my car fixed, and I found a quote and now she tells me there is no way in hell she can pay for damages!!
She first told me she had insurance, then I call her "insurance company" and I'm told her policy ended January 4th of this year. This makes me even more mad! I totally wish I called the police during the accident, but since she told me she had insurance I didn't even bother. Goddamnit! What should I do? I filed a claim through my insurance company just in case she bails out and doesn't pay for damages.
So I recently filed a claim to my insurance and I was wondering if I can cancel that claim if I wanted too?
Also, since it was her fault, my insurance rates wont go up even after I file the claim and this goes through, correct?
If I end up following through with my claim, is there a police report/documentation that is needed?

her insurance obviously isn't going to cover it since she has none. I thought you are legally required to have liability insurance? I would go through your insurance, less of a headache. you have full coverage, right?
option b would be going after her for the repair bill, but that will be a very long drawn out process and there is no guarentee it will work as you did not get a police report.
sorry, not much help here. why would you want to cancel teh claim? as long as no repair work has been started I don't see why you can't cancel.

If your insurance has to pay... your rates do go up regardless of who is at fault.
Did you have any witnesses? You might be able to do small claims court if you do.

The damage was very minimal, so I got a piece of paper and made the teen write that he admits to hitting my car (etc.. etc..) and signing at the bottom saying he would pay me for damages. In the end it was so minimal I didn't give a crap.

You have little choice except to get your car repaired utilizing your own insurance. That is unless you want to pay for the repairs yourself. My daughter got into an accident about a year ago where she was rear ended. The person who hit her didn't have insurance or a drivers license. To make a long story short, our insurance paid the $10K damages and have been trying to collect from the other person. They have not gotten a dime from her. And to make matters worse, her insurance went up as a result of the accident.
I would try to get a police report still. she will take it more seriously and will be more inclined to find a way to pay the damages, with more pressure put on her.

Well, I'm considering canceling my claim because I don't want my rates to go up for something that wasn't at my fault. Damages to the car, I was quoted $2,200-$2,500.

take it somewhere reputable and inform them you are paying out of pocket. buy parts on your own, have them do the prep/fitment/paint etc, save costs where you can.

you can get an aftermarket bumper, CF hood and fenders and 06 HIDs for less than that. start hitting up the market place.
WTF? Where can I find a Nismo V2 Front replica for $329?!? I looked and looked, but didn't find one for that price. Any fitment issues? I was tempted to go for the Amuse front replica, and maybe get some new wheels too since I just replaced my rear tires, I was going to use those upfront, and get new tires for the rears if I got new wheels. I'm not going to replace my hood, it's not in that bad of condition.

2) Your rates will still go up because there will be a claim on your record; regardless of anything being paid.

Legally, she needs to have liability. If not, your insurance company will go after her directly. A police report would've been nice, since they would have marked that, and written her a $500 ticket for no proof of insurance. As far as affects on your insurance, I'm not sure, but I'll try to find out.
I don't think that's necessary. Every accident I've ever been involved with has been settled without police involvement. Insurance companies don't require police reports. Granted, I've never been in an accident that had injuries and it was always crystal clear who was at fault.
