OP,
I would definitely have spoken to the owner as soon as it happened and gotten their insurance information. I had a similar situation a few years back with my Benz. I pulled into a car-wash (do it yourself pressure wash), and the drain was backed up so their was a puddle where the grate goes across the stall. To my surprise, someone had removed the grate (to unclog the drain I guess) and didn't put it back. My driver-side wheel dropped into the two foot deep hole, smashing the hell out of my bumper. It was not the property owner's fault, but he didn't hesitate to cover it through his insurance.
The pothole seems a little more avoidable, but hearing that they've patched it twice tells me that they know the problem exists and have not fixed it properly. If someone were to step in that same pothole and need medical attention, a lawyer would be all over McD's case. This, just like the lady's foot catching on the uneven cement, is matter of negligence.
This is not the city's fault (unless, of course, it was a city truck that spilled the paint). They cannot be expected to clean up paint spills immediately as they happen. This type of expectation is just not reasonable.

I was forced to continue on down a road in redmond a few months back in my Q45 and on this road a huge paint spill had just happened (yup still wet) ... white paint all up and down the side of my Q45... black Q45... i took pictures of the spill, i took pictures of my car, i took pictures everything and took my car in and got an estimate of 480 some odd dollars to get it fixed. luckily i work at a dealer with a body shop. because the city of redmond told me to eff off in a nice way. in the end i paid 200 bucks at my dealers detail shop to get everything repaired.

You guys and your "it's their fault" attitude. This is one of the big problems with society. Take some responsibility for your own actions. You drove your own car into a pothole and want someone else to pay, but even worse gixxert can't believe the restauant could possibly not be responsibile. Wow.
next thing you know they'll be suing for coffee being to hot... oh wait...

The pothole right outside of my neighborhood has been filled at least 5 or 6 times and it just keeps coming back.
The area of the hole isn't huge, it's just deep. Size of a width of a basketball. The deepest i've seen it had to be an around 4 inches.
My neighborhood also has a junior high right in the middle of it. So multiple school busses drive through it 5 days a week. Once the conrete cracks, it breaks even faster.
One time I forgot to avoid it and hit it. I thought I got whip lash.

If they claim they have tried to fix it I call BS. Unless by "fix it" they mean they shoveled some gravel into it, which would last less time than my span between visits. I don't remember any asphalt, concrete or grout ever being applied.
