Default Police question?

Hello. I heard from a friend that its illegal for police to have their headlights OFF at night when they are hiding around the corner to catch people speeding or running stop signs. Is this true?

You can fight it but you would have to get a lawyer. Judge will say its your word against his. Depending on speed, it might not be worth the trouble.

It doesn't matter. If they pull you over for speeding, and they had their lights off hiding around a corner, you're still getting a ticket, and it's not a defense argument that will hold up in court.

Police break the rules frequently, example: Police departments are only authorized a certain number of radar guns by the their FCC licenses. So if they catch you speeding with a radar gun that they aren't supposed to have in their possession, say unit #101, when their license allows for only 100 units... does that mean you are free and clear from the ticket? No.

I'm not sure if that's why you were asking, but if so yeah... it really doesn't matter.

I did a quick Google 'cause I also was curious. From what I gather, appears to be legal. Also, from what I gathered on the other stuff I gathered, and stuff, seems people are trying to use that argument as a basis to fight a ticket.

Im sure a lawyer can turn it into a speed trap or something along those lines.

Did he site you for your actual speed or did he hook you up and put you were going slower than you were.

i was told before that had to at least have parklights on, or its like entrapment or some crap. idk. but as stated before they dont care, you still get the ticket and theres probably a 90% chance that a judge wouldnt care he did it.

If its not required why do they bother leaving their headlights on? Ive seen police hidden on freeways but with headlights on. very noticeable. seen police at stop signs with headlights on. also very noticeable..

It's been awhile since I looked into the laws/regulations and stuff but I believe if they're sitting on a road/freeway where the speed is over 55MPH a speed trap is legal. Anything under it is not legal. His parking lights being on is good enough for him to say it wasn't a speed trap.

Regardless, if you were speeding and he pulled you over for speeding then it's speeding

entrapment is usally missused the only way entrapment can be used if you state that the cop forced you to speed and forced you to admit to a crime you didnt commit so if you commit the crime no matter if he was asleep and can still prove you were speeding the cop will win unless you declare to contest the ticket by written document and then ask for an extension for about a year then you can argue that the cop will not remember the exact details of the stop thus throwing the case out for lack of proof and you can also argue that the road hasnt been surveyed with a certain amount of years I forgot how much but you can argue that the use of radar was illegal because the road speed has not been updated so the use of the radar makes it an illegal speed trap which then throws out the radar evidence and then the case would be thrown out for lack of evidence but this cant be used in residential areas lol where I got my ticket

Run-on sentence. But anyways, have you ever tried this with a speeding ticket on the highway?

I've wondered the same thing. I would imagine keeping the running lights on is for their safety.

as stated above, i was always told that it was entrapment. but in the end result dont speed and you dont have to worry about it.
but on the other hand it would be interesting to find out

When was grammer a factor in a forum thread at least you can read sheeesh! Lol, highways have to be surveyed so the radar evidence can be valid. The road has to be bigger than two lanes and needs some sort of divider in the middle that is either an island or a bunch of lines that make an island. Is the grammer good english majors/teachers?
